A federal judge has ordered the government to give bond hearings in preparation for releasing hundreds of illegal immigrants from Iraq back into the community, saying the Constitution protects them from indefinite detention here in the U.S.
Judge Mark A Goldsmith, an Obama appointee to the bench, had earlier halted deportations for nearly 300 Iraqis, saying that although theyd long been ordered removed, conditions on the ground have changed and they deserved new hearings.
His latest ruling Tuesday evening goes further, certifying some of the Iraqis as a class-action lawsuit and saying most of them should be allowed to return to their productive lives while they wait for the new hearings meaning they must be released from detention, unless the government can prove they are a major risk to public safety.
Our legal tradition rejects warehousing human beings while their legal rights are being determined, without an opportunity to persuade a judge that the norm of monitored freedom should be followed, Judge Goldsmith wrote. This principle is familiar to all in the context of the criminal law, where even a heinous criminal whether a citizen or not enjoys the right to seek pre-trial release.
He said once someone had been held for six months, they needed to have a bond hearing.
At last count, there were 274 people whose deportations have been blocked by Judge Goldsmith, and he said the vast majority have been in custody of U.S. Immigration and Customs Enforcement for at least six months.

Judicial fiat is ruling our nation.

First he prevents them from being deported and then he complains that they have not yet been dealt with.
Truly an asshat of the lowest order.

I agree. He created the conditions that he now uses as justification to release them into society. I wish these judges would become responsible for any crimes they
end up committing. In other words, if one of them ends up murdering someone, they themselves becomes accessories to that crime.
The founders were right about only a natural born citizen as President.

IGNORE these judges ‘rulings’
STRIP them of their robes and kick them off their benches .
Anything more out of the them , arrest them , and sentence them to hard labor for 1-5 , for judicial malfeasance .

Note to Trump: Appeal the order and any order from Judge Goldsmith, while you administer them all hearings and in the hearings argue release will not be the right thing to do. Then they’ll have had their hearings. Then go ahead with the deportations.
The U. S. Constitution protects us, not foreign nationals.

So this fag “judge” is saying that the U.S. Constitution says Americans cannot detain enemy invaders that are in this country illegally. That’s some weird sh*t! I wonder which “Constitution” the boy is using and where he found his definition of ILLEGAL.
So, a judge can order an illegal thing, to wit: Release into a society persons who have no right whatsoever to be there? That about it?
It was a figure of speech, but I do still believe this will be fast-tracked to the SCOTUS.
