The VERY FIRST case the SCOTUS took on certiorari and decided (without oral argument) in 2017 is related to DACA where the Ninth Circus blocked HHS’s rescission of DACA. The SCOTUS’ ruling is not on the merits, but based upon the procedural screw-ups of the Ninth Circus.
“The Court now grants the petition for a writ of certiorari, vacates the order of the Court of Appeals for the Ninth Circuit, and remands the case.”
