Constitutional attorney shreds Sally Yates: ‘You don’t order an entire dept… not to assist sitting president’ [ full title]

A legal scholar and Constitutional attorney slammed former acting Attorney General Sally Yates for her “unprecedented” decision to defy President Trump’s executive order on travel and immigration.

Jonathan Turley reacted to Yates’ opinion piece published by USA Today on Tuesday in which she added her own side notes to the Constitution’s preamble.

Yates was fired in January by the incoming president after she ordered the entire Justice Department to not defend Trump’s travel ban. Though she did not name Trump in her op-ed, Yates has continued to be an outspoken critic of the president.

“The question really is whether she should be the messenger of this particular message,” Turley said, citing Yates’ own calls for the department to remain “apolitical.”

Turley was highly critical of Yates for the decision that led to her firing.

“Well, the action that she took I thought, was unwarranted. I was very critical of it,” the George Washington University Law professor said. “It’s unprecedented for an acting attorney general or attorney general to order the entire agency to stand down and not assist a president.”

She thought the travel ban to be unconstitutional. A unanimous SCOTUS - including the liberal justices - found otherwise. She should therefore take the hint and just go away. And she should have resigned rather than make that directive to the DOJ. It was a political action, plain and simple.

Maybe we need to tighten up the Standards just a little for Officers of the Court. In a Sane world, The BAR Association would have have Permanently Disbarred her Immediately for these actions. Nobody that behaves like this should EVER be “Allowed” to be an “Officer of the Court”

Of course it was. Obamatard made sure to place a lot of his minions and made sure “landmines” were in place for Trump. I do agree its hard to find replacements to work for a bloated govt.

Which is what people like her would do were there any sort of way to modify the Constitution, no matter how narrowly defined.

Washington DC is absolutely full of them. I know, I have worked there. They are usually intelligent people, who have also enjoyed the blessings of America more than most, and have risen in their apparatchik jobs in the government. They therefore become very arrogant and narcissistic. They lose humility, perspective and simply believe they are smarter and more virtuous than the rest of America.

The preamble is not a legally binding part of the USC — it lays out the principles for it and the moral framework but is not law (despite the fact liberals think “promote the general welfare” is the entirety of both the Preamble and the USC).

Here is her version (hold your nose and don’t read on an empty stomach). As was said by Turly I will stick to the original.

This is NOT a “Constitutional scholar.” This is a useful idiot with a law degree she probably slept into when she was younger and only needed 3 beers:

Nellie Ohr, worked with Steele on Fusion’s anti-Trump research. She is the wife of Bruce Ohr, then the deputy associate attorney general — the top subordinate of Sally Yates, then Obama’s deputy attorney general (later acting AG)... Ohr was a direct pipeline to Yates.
