In August, the Wall Street Journal Editorial Board labeled the case against Texas Attorney General Ken Paxton a political prosecution citing a sealed grand jury document provided to the editorial board. That document has now been published for the public to view by Direct Action Texas, a North Texas-based political accountability group and its contents are alarming.
The document, a motion to dismiss filed by Paxtons legal team, lays bare a number of violations of Paxtons due process rights by Special Prosecutors Brian Wice and Kent Schaffer, as well as Chris Older, the original judge on the case. Oldner was forced to withdraw from the case in disgrace after his wife was caught gossiping about the sealed indictments.
The grand jury materials provided by the Court show that the pro tem lawyers misrepresented the law, turned a blind eye to legal inconveniences, and wove facts from whole cloth, the Motion concludes.
The motion details a malicious and subversive effort by the prosecutors to obtain indictments against Paxton, including falsification of dates in order to avoid the statute of limitations, providing the wrong legal standards to the grand jury, and misleading the grand jury with immaterial information about Paxton.
In an earlier Motion to Quash the indictment, it was revealed that Judge Oldner had violated various laws relating to grand juries. This motion to dismiss adds additional detail, making it clear that Oldner improperly entered the grand jury room and worked to persuade the grand jurors to indict Paxton.
After Oldner was removed from the case, he was replaced with Judge George Gallagher of Tarrant County, who proved himself to be just as much on the side of the prosecution as his predecessor. Indeed, when Gallagher was confronted with the Motion to Dismiss, he not only refused to grant it, but he sealed it from public view.
Citizens need to be asking why this document was sealed in the first place. Was it sealed in order to cover up these abuses of power by the prosecutors? Are the prosecutors and judges who are attempting to railroad Paxton through the criminal justice system afraid of the public knowing about their corruption?
Its long past time that the Texas court system put an end to the corrupt prosecution of Ken Paxton. The Texas criminal justice system can no longer be allowed to be used as a political weapon against conservatives.
Not limited to just the Texas criminal justice system.
Those cases against Republicans were outrageous. They must have cost them a lot of money and much stress. We could use DeLay in the House right now.
Thats right...the RATS In Wisconsin with their John Doe investigations were used to war against their political opponents. The RATS have done similar oppressive actions across the nation.
Exactly correct.
This is precisely what is happening with the Muller prosecution.
He deliberately put attorneys on his team that are known for abuse of their power and corruption.
“Its long past time that the Texas court system put an end to the corrupt prosecution of Ken Paxton. “
Ditto for the RAT pack in Whacko with the Biker Prosecutions. You don’t know who is more crooked the Texas judicial system or the lawbreakers. but then, to be fair, Texas isn’t alone, it’s everywhere, and it’s all the RATs doing. Just never understood why Republicans are so inept at dealing with it, and that’s what I like about Trump, he’s not a Republican, he’s an American!
Agree 100%. This is going on all over the country.
Also not just limited to political persecution. There seems to be something wrong with more than a few convictions where the DA seemed more interested in convicting SOMEONE than in convicting the guilty party.
Not a bombshell. Hope the motion proceeds and charges dropped for Pax.
What we are seeing, is that with the Communist now achieving most of their 45 goals and seeing the end in sight, the pace has quickened to the over throw of this Country. The Communist supporters are pulling our all the stops to remove men and women of power who could slow down the progress that they have achieved. It is like a horse headed for the barn coming back from a long ride. Constant pulling on the reins can barely keep the animal in check and if you give it its head, it would break into a faster gait.
How much longer will that horse be held back since our Country has slipped below 50% producer and now the consumer or gimme dat runs the show which is like taking the bit out of the horse's mouth.
Will President Trump actually be able to withstand the onslaught and have the foresight to attack this enemy that is destroying us from within or will he lay over and be run over by the stampede.
I really do hate to say, but at some point, some of these people need to start hanging form a lamppost with a sign around their necks, documenting their crimes against the people and the country.
Lots of books out there on the subject.
Behind the Black Robes: Failed Justice
is a pretty good one.
Yes eartick
Very true!
In older times, this would have been taken care of quickly and decisively.
I don’t think it’s because they are inept. I think it’s because the republicans are in on it too, but they don’t dare speak up because it would also directly implicate them.
Yeah, Oldner was a Republican as I recall
Yeah, there’s some scumbags down in Milwaukee who are doing the same thing up here in Wisconsin.
That’s why I’m ultimately against the Death Penalty. I am for it in principal, but in reality it’s just another badly administered government program. With prosecutors it’s never about your guilt or innocence. It’s about their political career and whether they have a high enough conviction rate to make the next step up the political ladder.
I agree. When these public employees fear us, things will change for the better.
Sounds like the plot on Longmire right now.
Walt will win in the end however.
