Oregons colleges and universities must resist any Trump administration plans to walk back federal rules directing how schools respond to sexual assaults on campus.
That was the takeaway from a Monday morning roundtable discussion at Portland State University. Oregon Democratic Sens. Ron Wyden and Jeff Merkley and sexual assault survivor Brenda Tracy held an informal discussion with PSU Title IX leaders and sexual assault prevention staffers.
The meeting came less than a month after Education Secretary Betsy DeVos rescinded Obama-era guidelines on how schools should handle sexual assault on campus in favor of a process which DeVos said would treat all students fairly.
Nothing has changed immediately. The administration left the door open for schools to continue handling sexual assaults as they had previously, but the expectation is a final rules change could occur sometime in the next year.
PSU and other schools fear new guidelines would create more barriers to students who might consider reporting a sexual assault -- by making it easier for alleged attackers alone to appeal campus decisions on expulsion or other punitive measures, by opening the door to face-to-face mediation sessions between the accuser and accused, or by raising the standard of evidence needed for accusers to move forward with a complaint in the first place.
Schools must continue to confront these horrific crimes and behaviors head-on, DeVos said in a statement last month. There will be no more sweeping them under the rug. But the process also must be fair and impartial, giving everyone more confidence in its outcomes.

Agreed, that would get their attention in a hurry.
The Feds aren’t forcing this institution to take money from them. But once they do they agree to follow the rules. That’s been litigated and decided for decades.
