The Right to Discriminate Is a Basic Property Right

Back in 2013, Barronelle Stutzman, the owner of Arlene’s Flowers in Richland, Washington, refused to provide flowers for a gay friend’s same-sex wedding. The legal battle that ensued has now ended: The Washington State Supreme Court just unanimously ruled that the florist violated the state’s anti-discrimination law.

The case has given rise to some misconceptions about discrimination.

Here is the back story.

In 2012, the state of Washington enacted Senate Bill 6239, which recognized same-sex marriage. Gay men Robert Ingersoll and Curt Freed, who had been a couple since 2004, decided to get married in September of 2013. At the time of his engagement, Ingersoll had been a customer of Arlene’s Flowers and Gifts for at least nine years. Stutzman, an active member of a Southern Baptist church who believed that marriage can exist only between a man and a woman, knew that Ingersoll was gay and in a relationship with Freed. When Ingersoll spoke with Stutzman about providing flowers for his wedding, she told him that she would be unable to do so because of her religious beliefs. She gave Ingersoll the names of other florists who might be willing to serve him and hugged Ingersoll before he left the store.

Stutzman said she “draws a distinction between creating floral arrangements — even those designed by someone else — and selling bulk flowers and ‘raw materials,’ which she would be happy to do for Ingersoll and Freed.” But she said she believes that “to create floral arrangements is to use her ‘imagination and artistic skill to intimately participate in a same-sex wedding ceremony.’”

This article's a little old but I thought it was relevant since Jack Phillips' case is being heard. The only thing that even matters to me with this case is Kennedy. I know he ruled in favor of Hobby Lobby. Does anyone know how if he has ruled on any other religious liberty cases in the past, and if so, how he ruled?

If the government can usurp the right to free association, then what right can't it claim? The fact that an establishment may be a "public accommodation" makes not one whit of difference. There are some members of the public I wish to serve; there are others I do not. How is that any different than the fact that there are some people with whom I would gladly associate, and there are some with whom I would not associate at gunpoint?

I am not required to allow every person into my home. Why am I required to allow every person into my business?

Kennedy was the deciding vote making same-sex marriage legal throughout the land because after all it was only fair - I wouldn’t count on him to value religious liberty over not hurting some gay’s feelings......

What’s the problem with that.

It is possible that the fag was buying flowers for his mother’s birthday, or a sick friend, or something similar.

She didn’t refuse to sell flowers to him because he was gay. She refused to have one of her arrangements be a part of a gay wedding. She doesn’t hate the person, but she refuses to endorse the perverted ceremony.

Basic Property Right?

There are no property rights. You are allowed sometimes to use property as long as you pay the government rent on it (They call it 'property taxes' to make you think that you actually own it), or until the government or some special interest group decides that they have more right to it than you do.

Public accommodation laws should be abolished. There is no need for them, certainly not in the social media era. They are now being used to bully business owners who don’t follow the party line.

There's no “hmm”.
Flowers on display in the window or coolers are offered for public consumption. Floral arrangements for a wedding require a private contract of services for a private function. That is a participation in that private function.

Forcing someone to serve in a private capacity is slavery.

I’ve seen signs in restaurants near the beach that said,”No shoes,no service” .

(Maybe that’s considered a health issue.)

It is correct to say that all rights have limitations of one kind or another.

In a country ruled by law, everything has limits.

You cannot claim the right to self defense just because you do not like what someone is saying.

You cannot claim the right to travel across some one else’s property.

You cannot use your property (a weapon) to commit a crime without it being potentially forfeit.

But the limits also have limits.

We are limited creatures. We are limited in what we can perceive, what we can do, and even, what we can think.

We are defined by those limits. Without limits, we could not exist.

The limits may be very far from where we are, but they exist.

I got an email from Uber saying that they were going to fight discrimination by refusing to do business with anyone who has views of which they disapprove. Let that sink in for a minute. Now I’m refusing to do business with Uber because I disapprove of them.

The only people who have property rights are those with the means to defend those property rights.

She can’t refuse to sell him flowers, and besides she was dealing with an individual. When it came to being a part of his wedding, that was her line.

So can we now force a doctor or lawyer to work for us? Lots of doctors turn patients away (no more Medicare patients, not taking any new patients at this time, etc.) Can we force a country club to accept us as members regardless of race, gender, or golfing ability?
