So Charlie Gards fate now comes down to this: whether an American doctor can persuade a British judge that little Charlies life is worth living.

Actually, this is not the question at all. Charlie Gard is dying and nothing can change that. At this point, the question is whether he is allowed to pass peacefully, or to pass while he is being used as a guinea pig.
Having a “protocol” is much more to the liking of Government than an actual death panel with real people having their decisions reviewable by outsiders. It’s much easier to hide behind a law than admit that you kill people. The non-lethal version of that principle in this country is the BRAC process, in which Congress-critters never have to admit that they voted to kill a military base in their district. “I didn’t do it, the BRAC Committee did,” wile ignoring the fact that Congress set up the BRAC process in the first place.
