California and 17 other states sue Education Secretary DeVos for delaying new student-loan rules

California and 17 other states on Thursday sued Education Secretary Betsy DeVos, alleging she unlawfully delayed new federal regulations designed to protect student loan borrowers from being ripped off by for-profit colleges and other schools.

The rules, which would have made it easier for students to have loans forgiven if they were defrauded or deceived, were developed by the Obama administration and had been set to take effect last Saturday.

But last month DeVos delayed their implementation and launched an effort to rewrite them, arguing they were unfair to students and schools while putting taxpayers at risk for “significant costs.”

The suit, filed by attorneys general from 18 states plus the District of Columbia, said DeVos’ move violated the Administrative Procedures Act because she did not satisfy the standards for a delay, and also failed to give the proper notice or offer the public time to comment.

The suit also criticized DeVos for saying a reason for the delay was a pending legal challenge to the regulations by the California Assn. of Private Postsecondary Schools. The “reference to the pending litigation is a mere pretext for repealing the rule and replacing it with a new rule that will remove or dilute student rights and protections,” the suit said.

The States seem to be very confused about the US version of Federalism.

They want some sort of buffet line/ATM version where they demand money from the Feds with no strings attached and then pick and choose which laws they will and will not enforce.

States’ Rights are important but they are within a Constitutional context.

So, since they don’t like the delay in getting new student-loan rules, the obvious next step is to sue to make sure that new student-load rules get even more delayed.

Obama has been using Student Loan forgiveness to recruit his private army.
I know people who have been told to work for “non-profits” to get it.
Of course everyone of these “non-profits” have been an Obama activist group.

Gee. One has to wonder what the criteria for determining if they were "defrauded" or "deceived"?

Does that mean they applied for the loan, the loan was granted, and they signed on the line, that...what?

Anyone know?

What exactly does that mean? How does a "for-profit" college rip one off, but other colleges...don't? Or do they all fall under the "other schools"?

The lenders and schools have rights too. Many of those "students" misused the school loans for purposes other than getting an education. They abused an opportunity and expected to get off without responsibility for their own fraudulent behavior. The parties need their opportunity to be heard in court and plead their individual circumstances for use of the loan money. If the student chose basketweaving instead of a more useful field of endeavor, that is not a failure on the part of the school. Go weave baskets and repay your loans.

I can all but prove the person who wrote this story knew it was a pack of lies at the time he wrote it. The spreading-it-thick factor is turned up to 11, like a “help I’m stuck in a propaganda factory” note weaved into the narrative. The odds of this story being sincerely believed by its author are astronomical.

What on earth does that mean? Does that mean that a student expects to earn $100K a year out of college, but...the market is only paying $60K, or there are no jobs to be had, so...the loans are "forgiven"?

What the HELL is that? Are they saying the schools are telling them they WILL earn a certain amount, or guaranteeing jobs will be available years into the future?

If so, since when does a school tell that, and a student accept it as fact and a legal contract?

I got a degree, and they told me everyone got jobs when they graduate, but when I did, the job market for my profession was closed up pretty tight. Are they saying I could get my money back? Does the school take the diploma back?

Something about this STINKS TO HIGH HEAVEN.

There should be no forgiveness of student loans. Leaning agencies should be responsible for the loans they make. I think the amounts of loans should be predicated on the jobs an education will prepare you for. I think grades should be taken into accounts as well

There are some schools that convince people if the take a coarse in say Human Relations they will get big money when they graduate, the almost guarantee people will get a job. It’s a scam and Uncle Sugar pays these scam artists who take the money and run. i see people all the time who are saddled with huge debt, but they fell for it and no one should bail them out.

If the government want to help these people they should make sure people take on these loans with realistic expectations

Grrrr...I can feel my blood pressure rising just contemplating this.

I was listening to a reading of the Declaration of Independence at the Old North Bridge in Concord, MA on the 4th of July, and when the crowd was told that the the colonials were regarded as treasonous, and he asked the crowd "Who would be willing to commit "treason" today?", I raised my hand instantly. From the Declaration of Independence:

DECLARATION OF INDEPENDENCE: "He has erected a multitude of New Offices, and sent hither swarms of Officers to harass our people and eat out their substance."

ME: The Federal government has bloated, grown out of control and has taken on a life of its own, requiring an ever greater demand of our “substance”.
And this includes the taxpayer funded forgiveness of loans to idiots who put their signature on a dotted line to take money, and are too stupid to understand what the money means.

It should be treated as any other debt.

That would do a few things. For one, it would make the schools look at risk for lending student loans, and it would let those who need bankruptcy protection do so the same as any other debt.

Like I said, they told me that nearly 100% of the people who graduated from my program got jobs when they graduated. Well, several years later, things had changed.

I had to work temporary jobs until months later, something became available. I never, ever viewed that as a guarantee, and I am willing to bet none of these people ever got a guarantee, and if they did, they were too ROCK DAMN DUMB AND STUPID to have it put down in writing, which would never have been done in any case.

I could be wrong. Did any of these people get a guarantee in writing? Or were they “misled” or “deceived”?

Because if they were “misled” or “deceived”, it is on them 100%, or whoever signed for the loans. I am willing to bet none of them even looked at any kind of contract or statement when they enrolled or signed up.

Effing stupid idiotic snowflakes.
