Court Blocks EPA Effort to Suspend Obama-Era Methane Rule

WASHINGTON — Dealing another legal blow to the Trump administration, a federal appeals court ruled on Monday that the Environmental Protection Agency cannot suspend an Obama-era rule to restrict methane emissions from new oil and gas wells.

The 2-to-1 decision from the United States Court of Appeals for the District of Columbia Circuit is the first major legal setback for Scott Pruitt, the E.P.A. administrator, who is trying to roll back dozens of Obama-era environmental regulations. The ruling signals that President Trump’s plans to erase his predecessor’s environmental record are likely to face an uphill battle in the courts.

I was arguing from the perspective of an EPA legal team. The reason I can is that Congress has passed laws and then delegated the implementation to the EPA, which is done by policies, rules and regulations. Since people can be arrested and prosecuted and go to jail for violating those regulations I would argue they have the force of law.

In essence, the EPA has become another branch of government, at least, I would argue, the equal of Congress. But none of them are elected. They are the deep state.

I haven’t read the order but am guessing that since there are posting requirements and commenting periods to create rules, modifications need to follow the same procedures. Easy, Trump only has to say that while the rules remain for now, prosecutorial discretion means that they will put their enforcement efforts elsewhere in the meantime.

Is this judge alleging that once a regulation is promulgated it becomes part of the Constitution and cannot be rescinded? Many liberals would like to put that idea over, I'm sure. This is becoming a fight between the Courts and the other two branches for control of regulation and legislation. Courts are actually claiming the right to legislate. They have been effectively doing it for a long time but a court in South Florida now claims it as a right of the court.

Doesn’t that just fry you? The courts won’t ever stop the constant expansion of regulatory power be the illegal fourth branch. But they will immediately stop any effort to slow or reverse that expansion. Grrr...I’m so furious I could spit nails. Everywhere you look the GD government has metastasized into a monstrous tumor intent on eating away everything in the country.

Problem is, the EPA is full of Obama-droids. They will enforce the rule in defiance of any order not to. The court decision gives them cover to do so, and not get fired for insubordination.

Trump FAILED to ignore a court that was simply, CLEARLY out of bounds and so he WILL be their Bitch for as long as they care to push him around. That was a MAJOR failure on the part of the administration.
