Tennessee judges will have the authority to enhance sentences for defendants in the country illegally at the time of their crimes, under a bill the governor has signed into law. [ ]
Senate Minority Leader Lee Harris says hes disappointed the governor signed the bill. The Memphis Democrat says the measure will treat criminal defendants convicted of the same crime differently depending on where they were born.

I wonder if the American Communist Lawyers’ Union might challenge this.Maybe in the Federal courts...
A wall would be nice, but how about a giant catapult (or trebuchet) that could hurl Pedro back home?
Seems like they are guilty of 2 crimes. Being here illegally and the other crime.
Democrats lying, as usual. It treats those born in Mexico differently depending on whether they are here legally or legally. It does not treat those here legally differently depending on where they were born.
And the real problem is not being soft about the second but in the nod and wink about the first.
I give this one 50/50 chances in the USSC, maybe. Sometimes it is not wise for conservatives to taunt the bull, weakening and dying as it may be.

And the big risk here is PR damage. If you wanted to get the bleeding hearts to bleed, you just did. Now whether you like the results, is another matter.
BIG difference...when Arizona passed SB1070, and Alabama followed suit, Obama and Holder came down on them with full Federal force. They are GONE, liberal swine! You won’t stop us now.
Courts have ruled that non citizens and even illegal aliens are protected by the Equal Protection Clause.
True, but using illegal entry to enhance a charge might just pass legal muster...
Meant enhancing a sentence...
It might, but a federal judge may rule the ‘illegal entry’ is a federal matter while the state charges are a state matter.
Good point! Well, back to the Holiday Inn Express for me ;-)
Courts have ruled in favor of slaveowners and “separate but equal” in the past, too.
In that case, it’s going to Trump’s desk and not Obama’s anymore. Does a liberal federal judge want the buck to go there and stop there?
“In that case, its going to Trumps desk and not Obamas anymore.”
What would go to Trump’s desk?
Kabuki.
Just turn them over to ICE.
The spirit of the RINO is strong in Tenn. Republican officials. Especially the Governor.
“Courts have ruled in favor of slaveowners and separate but equal in the past, too.”
And it took a war and a few constitutional amendments to straighten that out.
Insistence on federal control in the matter of illegals. There isn’t going to be the Obama-era lenience.
Indeed so. So one can see where the left wants to push this.
