Doesn’t matter what Obama said about it. There was no law mandating that you buy insurance. Instead there was a tax on people that didn’t. It clearly was a tax. It’s hard to see how Roberts is wrong about that. That doesn’t make Obamacare constitutional, it just means that the individual mandate argument wasn’t the winning argument.
It never would have been passed by Congress if it were sold as a tax.
Maybe not, but doesn’t really matter. Congress passes a written piece of legislation. What matters is what it says. What a judge has to rule on is what it says.
I do too, but let me say I wouldn't put it past one of the squishes on the so called right to fold. I seriously doubt the ones on the left will rule against the lower court. No recusal from Ginsburg, there are no rules for the left that go against their agenda.
I expected Obamacare to be overturned as well, I think we all know how that worked out.
