There was absolutely no basis for the ruling based on any constitutional foundation, and for that reason alone it should be thrown out on appeal.
Judges who have consistently failed to rule on the basis of the Constitution should be subject to impeachment and removal from the bench. This would probably take out some 75% of all the Obama nominees that were seated.
