"When the intruder refused to leave and threatened the rightful owner of the home, could the homeowner been in reasonable fear for his life?" If the HOUSEowner feared for his life, he wouldn't have gone back in. He would have called the police.

Mason County Prosecutor Michael Dorcy said Tuesday that Rosa had been at a nearby friend's house Friday night and took a walk early Saturday after getting into an argument. Rosa might have mistakenly entered Fanning's building, which has an identical floor plan to the house where he had been visiting his friend, according to Dorcy.

The friend's residence has the same floor plan and design as Fanning’s home business office, Dorcy said.

At some point during the early morning hours, Rosa and a friend had a disagreement and Rosa gathered his shoes and went for a walk. He did not have his own car with him, and detectives noted his clothes, found on the bathroom floor, were wet, indicating he may have spent considerable time outdoors. Temperatures dropped to the upper 30s that night, Dorcy said.

In addition to determining if Rosa was intoxicated, Dorcy said investigators will attempt to determine whether he was hypothermic, which may have contributed to a sense of disorientation. Fanning reported signs of forced entry to the building, and Dorcy said he may have believed he was at his friend’s house and assumed he had been locked out.
