Trump has Already Effectively Repealed Obamacare (Dick Morris)
Facebook ^ | Dick Morris

Posted on 03/27/2017 8:26:37 PM PDT by LS

Dick Morris says what I have said for a couple of weeks. Obamacare really has been killed, and no one noticed.

Trump told the IRS not to enforce the "individual mandate." That is the essential coercive element. No mandate, no O-care. Morris said he did this last week---in fact, I heard more than four weeks ago that the IRS was NOT enforcing this and just assumed it came from Trump.

Second, the requirement that you buy from an "approved" insurance company---Trump waived that as well by telling HHS to approve any policy as "qualifying."

Yes, some of the subsidies and other crap remains, but the individual mandate---which the USSC upheld---is gone and so is the other coercive mechanism.

And nobody noticed.

Thats probly every bit the establishment’s agenda. Its on the books and you see how easy it is to railroad a good bill or ram rod a bad one, SO, the longer it stays on the books the longer 90% of Legislature can use it punch their clock every day instead of something else constructive.

Its imploding and Trump gutted it and the congress refused to do anything about it except let it FAIL.

Correct. But it is much easier to repeal a law not enforced, like Prohibition.

The non-enforcement is a testament to the poor quality and lack of support the law.

Obamacare won’t last 4 years without the mandate.

Ummmm.... Why exactly would Trump need to tell HHS to every policy is “qualifying” if the IRS is not enforcing the mandate? Smells like BS to me. Repeal, in full, in front of the entire MSM bank of cameras and microphones. No replacement, other than free citizens free to choose what they want, from whom they wish, as they see fit. Anything else is a failure.

Here, here ! The constitutionality of the law IS the problem.

Total repeal somehow with a censure on the Supreme Court for being total idiots on this.

And Obamacare won’t survive without the mandate to join.

but the individual mandate---which the USSC upheld

Actually they did not.

They called it what it was: a tax.

First, barkiecare wasn't healthcare, it was insurance.    But when there is a mandate to buy it, and deductibles are so high you can't afford to use it, it's neither healthcare or health insurance, it's just a tax.

Maybe so, but as long as it remains on the books, some future Dem president can reinstate the provisions.

It must be killed now! Then salted and burned. Then covered with lye. Then buried and covered with concrete.

There is another mandate that incidentally Reagan signed. The mandate on hospital ERs to take in whoever shows up with no reimbursement.

How about getting rid of that mandate?

If the government decides that everyone should be taken care of medically regardless of whether one can pay or not and without any reimbursement, then shouldn’t everybody be also mandated to carry health insurance?

You can’t have one without the other.

I don’t think you have to pay the penalty. That’s what I was getting at. Ask about that, specifically.

That’s not the way I read it. Trump told the IRS to process returns that do not have the insurance information required rather than reject them for being imcomplete. People are still required to have insurance and are still subject to the penalties.

I need insurance, I am paying double from last year after my insurance was cancelled, I don't give a flying fudge about the penalty, that's what I'm getting at

How do you read this?

====================================================

Sec. 2. To the maximum extent permitted by law, the Secretary of Health and Human Services (Secretary) and the heads of all other executive departments and agencies (agencies) with authorities and responsibilities under the Act shall exercise all authority and discretion available to them to waive, defer, grant exemptions from, or delay the implementation of any provision or requirement of the Act that would impose a fiscal burden on any State or a cost, fee, tax, penalty, or regulatory burden on individuals, families, healthcare providers, health insurers, patients, recipients of healthcare services, purchasers of health insurance, or makers of medical devices, products, or medications.

No penalty. No enforcement. No mandate.

This won’t lower the cost of health plans just yet, but it will ensure the collapse of the exchanges that require lots of young healthy people who pay but get no benefit because of absurd deductibles.

Thanks to the President’s EO, I don’t have to worry about surrendering 2.5%+ of my income or pay $5k in premiums with a $6.5k deductible to keep other welfare state parasites alive.
