I don’t think Bartnicki applies in the case. I will post a longer response tomorrow. The press does not have a blanket exemption from laws that relate to the disclosure of confidential information.

So if Rachel Maddow received a stash of cash that was part of a burglary, would she be in trouble for using that stolen cash? How is this any different? Are the feds afraid to arrest her?

Fox hinted that the returns may have been left in a reporter’s mailbox by the ‘Trump administration’.

Would certainly be consistent with Trump’s boundless ability to make fools out of these people.

He’s still playing 3d chess while they struggle with checkers.

He should sue her for $1,600,000 because this is what he would get paid in four years, if he had accepted a salary, which he did not. If he does run for reelection and reelected the sum doubles

They can identify the leaker. I work for the largest financial firm in the world and if a high profile’s account is accessed they know within minutes who did it. If you do not have a tied business purpose then oh are walked to the door immediately.

They can find out who accessed the file to print off (if it was the IRS that did it)

Look at NY law.
they have one.

It addresses a multitude of entities and how you are not allowed to reveal social security numbers.

Employees, customers, and other individuals in situations where the number is revealed in whole or in part.

Go find an exemption to it if you think it is legal

Maddow looks very worried that her big scoop turned into a “Trump for President” ad...so our President paid $38 million in federal taxes in 2005...I think about 3,000 people on welfare should send a thank you note to Trump!!

Maddow looks so troubled right now because she ginned up the news only to let all her wacko left wing followers down big time. The man paid a 25% federal tax rate!!!

First Amendment gives the highest protection to political speech. Much less protection to commercial speech and no protection to speech that is in furtherance of a fraud.

Releasing someone’s SSN has no legitimate purpose which could be served. The only intent that can reasonably be inferred is the intent to defraud. Thus, no protection.

Not all speech is protected speech. You can’t yell “Fire!” in a crowded theater either.

MSNBC has no duty to keep the number confidential. Employers, health care providers, tax professionals, etc. do have that duty. If someone at the IRS leaked the returns, a crime has been committed. MSNBC has committed no crime and is fully protected by the 1st Amendment.

I think you could stand to have a refresher course on Bartnicki v. Vopper.
