Yes, There Could Be Serious Legal Problems if Obama Admin Involved in Illegal Surveillance
lawnewz.com ^ | March 4th, 2017 | Robert Barnes

President Trump recently tweeted claiming that former President Obama wiretapped him during his campaign.

The stories currently are three-fold: first, that Obama’s team tried to get a warrant from a regular, Article III federal court on Trump, and was told no by someone along the way (maybe the FBI), as the evidence was that weak or non-existent; second, Obama’s team then tried to circumvent the federal judiciary’s independent role by trying to mislabel the issue one of “foreign agents,” and tried to obtain a warrant from the Foreign Intelligence Surveillance Act “courts”, and were again turned down, when the court saw Trump named (an extremely rare act of FISA court refusal of the government, suggesting the evidence was truly non-existent against Trump); and so, third, Obama circumvented both the regular command of the FBI and the regularly appointed federal courts, by placing the entire case as a FISA case (and apparently under Sally Yates at DOJ) as a “foreign” case, and then omitted Trump’s name from a surveillance warrant submitted to the FISA court, which the FISA court unwittingly granted, which Obama then misused to spy on Trump and many connected to Trump.

Under section 1809, FISA makes it a crime for anyone to either “engage in” electronic surveillance under “color of law” under FISA without following the law’s restrictions, or “disclose” or “use” information gathered from it in contravention of the statute’s sharp constrictions.

FISA can only be used for “foreign intelligence information.” Now that sounds broad, but is in fact very limited under the law. The only “foreign intelligence information” allowed as a basis for surveillance is information necessary to protect the United States against actual or potential “grave” “hostile” attack, war-like sabotage or international terror.

our previous discussion of this excellent analysis, which is well worth posting again:

http://www.freerepublic.com/focus/f-news/3531564/posts

What really intrigues me is “Why”?” Wiretapping a Presidential candidate is not exactly low-risk, and they tried very hard, including two requests to the FISA court. Someone wanted this VERY badly! Why would they need this wiretap when Hillary was winning every poll and had the election wrapped-up (according to the MSM)?

The logical answer is, they knew what we knew - that the polls were being faked to hide the truth and someone was desperate enough that the risky wiretap push was worth the cost.

The phrase “follow the money” originated from the Watergate investigation. In the Towergate investigation maybe we need to “follow the paranoia”.

That’s an excellent idea. Rudy knows how to expose the maze of traitors and deal with them.

I'd love to see all of them SWIMMING in Guantanamo Bay, being followed closely by a couple of great white sharks. Paging Katharine Lee!

I hate to ask...would Attorney General Jeff Session’s previous recusals prohibit him from overseeing an investigation into Obama’s wiretapping of Trump?

I posted a theory about that on another thread. See Post #45 in the thread linked here:

Trump Wiretap is the REAL Scandal of the U.S. Election

Very astute, laplata. You know it is curious we are not hearing a word from, or about, Rudy.

I believe he was brought on board the Trump adm., for “investigations”, specifically. The silence is so deafening that he may be in the basement of the White House doing exactly that.

Or, not.

Sessions' recusal now makes even more sense to me than it did two days ago.

He can't oversee an investigation into Obama's wiretapping of Trump because his own calls and e-mails with the Trump campaign were probably intercepted.

He didn't recuse himself because he did anything wrong. He recused himself because he might be a witness for the prosecution.
