Yes, There Could Be Serious Legal Problems if Obama Admin Involved in Illegal Surveillance

President Trump recently tweeted claiming that former President Obama wiretapped him during his campaign. One can only imagine how nuts the media would have gone if the roles had been reversed: President Trump wiretapping either Obama or the Clintons, though his DOJ could have authority to do just that given the expansive leaks of intelligence information by Obama and Clinton supporters the last few months. Heck, he could wiretap the media at this point, legally and legitimately, as the sources of these unlawful leaks, for which Obama himself set precedent. Do liberals understand what Pandora’s Box Obama opened up by Obama using the powers of the NSA, CIA and FBI to spy on his political opponents? Even Nixon never did that.

If the stories are correct, Obama or his officials might even face prosecution. But, we are still early in all of this and there are a lot of rumors flying around so the key is if the stories are correct. We just don’t know at this time.

Good analysis from an experienced attorney, with many details for those interested in them.

What I'd like to know is, under 50 USC 1805, is it possible to have a wiretap order issued strictly on the authorization of the Attorney General?

Here is a snippet that contains the wording in question:

"the judge shall enter an ex parte order as requested or as modified approving the electronic surveillance if he finds that - (1) the application has been made by a Federal officer and approved by the Attorney General"

Since we know the request was turned-down once by the FISA court (a rare occurrance indicating the reason for getting the wiretap approval were really weak) - did Obama turn to his own AG to go ahead and do it anyway?

That’s the other possibility. Warrantless statute. Really shady stuff there.

I don’t see where there is any definitive answer on the question yet; if it was warrantless or with probable cause affidavits.

This is criminal — ABSOLUTELY. This is why the fabricated Russia /Trump bull ship was being peddled to idiots!! I have never seen any abuse of office to this magnitude in my life . The make Watergate look like play school, I fully expect some peopple to start flleing the country. Trump needs total air port shut down on these criminals!!

What if the whole warrant process was nothing but a papertrail fraud, before and after it was issued, and a rubber-stamped judge who’s in the crime to begin with?

The level and depth of Obama administration corruption we are going to find may be staggering.

Beats me vet, but you can say one thing: unlike the stuff the democrats have been tossing up against the wall hoping something sticks, there is solid proof here. AG Sessions now has the keys to all those locks and, to quote the inimitble Wilford Brimley in “Absence of Malice” all the FBR and DOJ asses can go into his briefcase.

According to experts like Col. Tony Schaefer on FNC there is no question that the wiretaps were done, so there is a paper trail. We will know who issued them and why, who knew about them and when, and it will undoubtedly lead to Obama, who will have the choice of being incompetent or a liar.

Now we see why they have been so desperate to pin some “Russian thing” on Trump. THey knew this was eventually going to come out and they know the wiretaps yielded nothing. This is going to be bigger than Watergate.

That’s how it should work but from what was said on Fox tonight, they didn’t have it, this WAS a fishing trip under the heading of “due diligence” and had they found anything that would have been proffered to justify further actions.

We’ll find out. But it sounds like they had as much probable cause as a redneck sheriff has to pull over a carload of hippies...

Bottom line is that a sitting President WIRETAPPED the candidate from the other party DURING an election. There is no way on God’s green earth that this was not political in nature.
