In its final days, the Obama administration has expanded the power of the National Security Agency to share globally intercepted personal communications with the government’s 16 other intelligence agencies before applying privacy protections.

The new rules significantly relax longstanding limits on what the N.S.A. may do with the information gathered by its most powerful surveillance operations, which are largely unregulated by American wiretapping laws. These include collecting satellite transmissions, phone calls and emails that cross network switches abroad, and messages between people abroad that cross domestic network switches.

The change means that far more officials will be searching through raw data.

This was posted on FR about a month ago, but I thought I would repost it because it might be relevant to how Obama loyalists within the intelligence community were able to obtain access to transcripts (and audio) of Flynn phone calls.

In his last week in office, Obama signed an extension of Executive Order 12333, giving analysts in 16 intelligence agencies unprecedented access to the vast amounts of data collected by the NSA, including just about everything that is transmitted over fiber to Europe.

The previous EO 12333 was scary enough in the unbelievable amounts of data it allowed NSA to collect. Now many more people will have access to it, including, for example, people like Snowden, who passed classified information to WikiLeaks, or the Obama moles, who leaked information damaging to their opposition to the press.

Once Trump cleans out the intelligence agencies, he and his intelligence community will have control of that data, including being able to look back on the history of Democrats talking to foreign powers.

Jay Sekulow outlines the case [Video Here] that President Obama set-up a plan for the intelligence community to target President Trump.

Specifically through the use of a lame-duck executive order, President Obama authorized multiple intelligence agencies to have access to Signals Intelligence (SIGINT) including phone call intercepts.

(Via ACLJ) […]  First, as the New York Times reported earlier this week, in its final days, the Obama Administration expanded the power of the National Security Agency (NSA) to share globally intercepted personal communication with the government’s 16 other intelligence agencies before applying any privacy protections.

The new rules were issued under section 2.3 of Executive Order 12333 after approval by two Obama Administration officials: Attorney General Loretta Lynch and Director of National Intelligence Director, James Clapper.

Second, the new rules, which were issued in an unclassified document, entitled Procedures for the Availability or Dissemination of Raw Signals Intelligence Information by the National Security Agency (NSA), significantly relaxed longstanding limits on what the NSA may do with the information gathered by its most powerful surveillance operations.

These operations are largely unregulated by American wiretapping laws. Surveillances include collecting satellite transmissions, phone calls, and emails that cross network switches abroad, and messages between people abroad that cross domestic network switches.

The changes initiated by the Obama Administration in its waning days empowered far more agents and officials to search through raw intelligence data. As a direct consequence of the change in policy, it appears that the prospect of intel leaks grew exponentially. Attorney General Loretta Lynch signed the new rules permitting the NSA to disseminate raw signals intelligence information on January 3, 2017 after Director of National Intelligence James Clapper signed them on December 15, 2016.  (read more)

The dates here are key, because it was after the 2016 election when DNI James Clapper was reported to be recommending the removal of NSA head, Admiral Michael Rogers:

[November 19th, 2016] (Reuters) The heads of the Pentagon and the U.S. intelligence community have recommended to President Barack Obama that the director of the National Security Agency, Admiral Michael Rogers, be removed from his position, sources familiar with the matter said on Saturday.

The recommendation by Defense Secretary Ash Carter and Director of National Intelligence James Clapper, first reported by The Washington Post, was delivered to the White House last month.  (read more)

Flynn called the Russian ambassador (or maybe the Russian ambassador called him — whatever).

Any spook as experienced as General Flynn would have to know that such a call would be recorded and analyzed. Russian ambassadors are routinely bugged, people! Duh! He knew whatever he said would be picked apart by his former colleagues in the Intelligence Community! Who got his ass fired as head of the DIA under Obama for uttering a correct analysis of Islam!

That was my question. Why not un-do this Exec Order? What are the pros and cons? We learned that 9-11 had the “wall” between FBI and CIA and that was dumb. So isn’t sharing of information good as well as bad?

I think the more important question is - Why are there 16 Intel Organizations? Doesn’t it sound like a merger and consolidation is needed? This sounds like it would be in business man Trump’s wheel house. I would think in ten minutes that 16 could become 3-5 groups. Period. It sounds so inefficient where right hand won’t know what left hand is doing and prone to internal “office politics” style struggles. Just like in bloated Corporations

Obama Administration Releases Long Awaited New E.O. 12333 Rules on Sharing of Raw Signals Intelligence Information Within IC January 12, 2017 The New York Times reported this morning that the Obama administration has put into place new rules allowing the NSA to disseminate “raw signals intelligence information.” According to a 23-page, mostly declassified copy of the procedures, released today, Director of National Intelligence James Clapper signed the rules on Dec. 15 and Attorney General Loretta Lynch signed them on Jan. 3.

Now, the irony in all of this Flynn brouhaha is the timeline...

Dec. 29, 2016 — Obama administration unveils sanctions against Russia for election-related hacking, expelling diplomats and shutting down two compounds. The same day, Flynn speaks to Russian ambassador Sergey Kislyak by phone.
Snip Sometime after Dec. 30, 2016 — The FBI reviews intercepts and finds the Flynn-Kislyak conversation. The matter gets folded into the FBI's ongoing probe into Russian election-related hacking and related issues.

Raw 12333 surveillance sharing guidelines

I don't see anything that makes these new guidelines applicable to communications before the guidelines were issued.

Ex post facto comes to mind.

To me, this is Obama setting up a plan for a political coup against the incoming President Trump. this executive order, combined with his loyalists in the government and his conversion of his campaign organization, “Organizing for Obama” into its new name, is the basis for that plan.
