A Modest Proposal on What to do with the 9th Circuit Court.

The 9th Circuit Court in it’s current embodiment is a disaster. The latest constitutional crisis is a perfect example. A rouge judge put a stay on the implementation of an emergency executive order without doing any of the necessary legal groundwork, foundations and augment. This was approved by a panel of three judges also without establishing the necessary legal foundations to support the stay. This is more than just angering, it goes against everything the Constitution stands for. The stay effectively takes power away from the Executive branch and gives them to the judicial branch without Constitutional precedence. These incompetent judges through their arrogance has [1] subverted the Constitution, [2] created a Constitutional crisis and has [3] tied the hands of those who are entrusted with defending the United States.

There is a Constitutional solution to this fiasco. I wish to present it here for consideration;

Whereas, the 9th Circuit Court are empowered in their roles as judges for life, and they are obviously incompetent, or criminally negligent as determined by the frequency of overturning of their judgements, and that Congress has the power to control the shape and structure of the Circuit Courts;

  1. The territory that falls under the purview of the 9th Circuit Court is to change and from now on be strictly limited to the Aleutian Islands,
  2. Three new circuit courts are to be created to cover the former territory that remains after removal from the 9th Circuit Court’s purview, sans the Aleutian Islands.
  3. All of the 9th Circuit Judges, shall maintain and keep their lifetime roles as judges in the town of Adak on Adak Island.
  4. Renovation of the former military barracks on the island shall be authorized by Congress but shall be in alignment with the quality of the judge’s legal ability.
  5. Congress shall appoint new young conservative and libertarian judges with a strong belief in the constitutional principles established by our constitution to the three new circuit courts that are spawned from the realigning of the 9th Circuit Court.

While this modest proposal seems outrageous on it’s face, it is not. Everything listed above is in complete constitutionality and within the purview of Congress. Implementing this proposal is far less outrageous than some of the rulings that the 9th Circuit has made in the past.

I think this is a great idea. It is ballsy and should be done.

Actually, I’d make three simple suggestions:

1. Dump the whole circuit program, and just make it fifty appeal court operations....one in each state. Limit it to four judges...of which it’ll revolve on each case around three judges hearing the case, and rendering an appeal result. The fourth guy is there in case of health issues or vacation periods....strictly to fill in.

2. Mandate that each state court has to be in a city beyond the state capital of the state. Limit travel expenses of the four members to strictly inside the state, or to conferences in DC.

3. Mandate that each member appointed must have a minimum of three years residence in that state, and a license to practice within that state.

fantastic idea.

please float this to the president.

also he needs to start just nominating more and more scotus justices and get the number up to 11 or 15. nothing mandates it has to be 9.

No. Don't put them where their special talents will be wasted!

As their recent 29-page opinion points out, they are the world's foremost experts at vetting refugees to weed out the terrorist plants from the good ones.

Why, they're so skilled at seeing what's truly in the heart of a total stranger, that they likely don't even need interpreters to do this critical job.

Therefore I propose they be sent to Mosul and Aleppo ASAP.

The first thing needed to be done is to fast track and confirm Scalia’s replacement...next week if necessary. Also every single vacancy on the lower court level needs to be filled promptly. I understand that number is in the hundreds.

This is war and it’s time to go to the mattresses. The leftwing will certainly go nuclear again the first chance they get. It is time for a reality check.

The flaw with this is; Libs will just go judge shopping to the Aleutian Islands. As long as these judges are still active they can continue to make their illegal edicts.

And filled with conservative jurists who actually believe in the US Constitution. END the practice of requiring potential judge appointees to be approved by the Senators who represent the state in which the court is located. ‘RAT Senators will NEVER approve the types of judges we need to rescue our thoroughly corrupted judicial system.

The Aleutians are too close to civilization and too hospitable. How about the gloriously small and remote Johnston Atoll in the vastness of the Pacific, with a requirement that the Ninth Circuit’s judges all reside there?

I think their district should be San Francisco and LA. All 29 judges are to remain in the 9th circuit. They can apply to be part of any of the new districts but they would have to be reconfirmed to do so.

This entire thing must be accomplished immediately and new judges confirmed prior to 2018

Why couldn’t you just dissolve the entire circuit court system and redraw the boundaries for those courts and all judges there to would have to be re-nominated and re-confirmend.

This is a great idea.

Fed District Judges are protected by lifetime appointments, and it is illegal to fire or discontinue paying salary to one without Impeachment, but they have no protection over Congressional adjustment of their District.

Ya could even move the Courthouse to the Aleutians and make them hold court there.

It would seem to me to be more sensible to just have 50 courts....one for each state, with three primary justices and one back-up judge. You could draw this up in a week, and pass it fairly easily. I don’t see how any Democrat would be against it....it’d put the judges within that state and ensure a quicker review process. Maybe while doing this...put some rule in that once nominated...you can only remain there for eight years max.
