Just hypothetically, I wonder what would happen if a conservative mayor decided to make a "sanctuary for the unborn" city. This could be done by ignoring existing abortion restrictions and saying no more abortion in his/her city?
If liberals can play the game of disobeying those laws which they dislike, why can't conservatives?
A very good question. And no, while not overtly advocating this, the question brings the focus on the need for the Rule of Law, and the consequences of ignoring it.
I have advocated for income tax free sanctuary cities.
Another option which would be guaranteed to provoke a reaction is if cities were to declare themselves “gun law free”, refusing to obey state laws.
Hey, it could happen ...
The supreme court has been narrowing roe v. wade since pp v. casey. so state and local jdx can do a lot to make it hard to have an abortion clinic, legally. http://www.lifenews.com/2017/01/17/abortions-hit-record-low-abortion-activists-admit-pro-life-laws-saving-more-babies-than-ever/
How about a EPA free city?
How about a NEA free city?
How about a illegal alien free city?
How about a ....
The left would go crazy over any such suggestion, but it is okay for them to pick and choose which laws to obey...madness.
How about a gun owners sanctuary county in California where you can own Semiautomatic weapons with standard capacity magazines. Wouldn’t that make the liberals heads explode!!!
Good ideas. With a little creativity we could probably come up with several laws we don’t necessarily like and declare city sanctuaries where they need not be obeyed.
It would be a great test to see how the left responded to their own tactics.
Thanks.
I would really like to see a republican mayor, pick any issue, abortion, guns, taxes and declare that his/her city will not be obeying the law on that issue until liberal immigration sanctuary cities diappear.
Make the left get a taste of what they are doing. See if they like it.
The dream, liberal-free, socialist-free sanctuary cities. Then states.
my husband says “ federal income tax” sanctuary cities!!!
I’m an attorney (yes, I know, everyone here wants to kill me first). I also act as a faculty advisor to our high school Constitutional Law debate team. I read up on the Supreme Court opinions and follow current constitutional issues. What offends me the most as a conservative is the hypocrisy of liberalism, and how it has perverted the notion of the Rule of Law.
To me, the essence of the Rule of Law is the idea that “sauce for the goose is sauce for the gander.” If you make a rule, it works both ways. For example, in 2007 the Supreme Court decided in Massachussetts v. EPA that states had “special solicitude” in determining standing to sue the Federal government over Federal policy. In that case, Massachussetts wanted to compel the EPA to declare carbon dioxide a pollutant as a “greenhouse gas.” The liberals loved that ruling.
Fast forward to 2016, when Texas sought to declare the 0bama regime’s DAPA illegal immigrant policy unconstitutional. The liberals screamed that Texas did not have standing to sue; Texas responded by pointing to Massachussetts v. EPA. You liberals created this monster, now don’t be shocked it has turned on you. Oh, how I would have loved to see Justice Scalia point that out in an opinion expressed as only he could. It would have been wonderful.
Yet another example: Citizens United v. FEC. How dare evil CORPORATIONS assert that they have 1st Amendment rights! Why, it was a horrible opinion that agreed with them and gave them 1st Amendment rights! This was never contemplated by the Founders! Unprecedented!!!!
Except that it was not. In 1962, the NAACP sued the State of Virginia over a statute that prohibited corporations from soliciting public interest lawsuits. In NAACP v. Button, the Supreme Court held that CORPORATIONS DO IN FACT HAVE 1st AMENDMENT RIGHTS. How convenient that the left forgot about that 60 year old precedent.
So the left will construe the law to obtain a result they want, then ignore the same construction if it would drive a result they don’t want. And that sort of hypocrisy is totally contrary to the concept of the Rule of Law, and results in our country descending into the totalitarian banana republic type of country the Founders wanted to avoid.
Excellent post!
There are lots of things that drive me crazy about liberals and what they do. But the constant quest to gain ground by cheating with double standards is the worst. And worst of all, they often get away with it.
Indeed thats why I proposed a conservative sanctuary city of no abortion (or any other issue) to show the liberals what scofflaw, double standard loving, ^&#@s they are being with their immigration sanctuaries.
Good idea.
As far as I know, there isn’t any federal law that allows for abortion. We only have, in my view, an unconstitutional ruling allowing for murder of the pre-born.
A city prohibiting abortion would be following the orginalist and correct interpretation of the US constitution.
