ATMORE, Ala. (AP) — A condemned Alabama inmate has survived the seventh attempt to execute him by lethal injection thanks to a last-minute stay from the U.S. Supreme Court.

In a split decision, five justices voted late Thursday to stay the execution of Tommy Arthur as the high court considers whether to take up his challenge to the state's lethal injection procedure. The reprieve came shortly before 11 p.m. as Arthur, 74, was waiting in a holding cell outside the execution chamber at a south Alabama prison. His death warrant expired an hour later, and Arthur was returned to death row to await the next development in his 3-decade-old case.

"We are greatly relieved by the Supreme Court's decision granting a stay and now hope for the opportunity to present the merits of Mr. Arthur's claims to the Court," Arthur's attorney Suhana Han said in a statement.

Maybe so, but politically I wouldn't just give in. I'll make this trade with liberals: I'll agree to ban capital punishment if they'll agree to ban abortion.

God invented the death penalty, knowing the evil in the heart of man.

Chief Justice John Roberts didn’t think the case warranted a stay, but voted for it anyway in consideration of four other Justices who wanted a better look at the case. This guy doesn’t deserve to be a Justice let alone a Chief Justice. I think history will show him to be the most screwed up justice in history with the most convoluted reasoning ever.

Also that life without parole is actually the rest of the convicts life, without parole. And no endless number of appeals either, no appeals due to health or age issues.

Well, G-d set up the death penalty in the books of Moses. An eye for an eye. This man is guilty. They need to serve justice.

God invented the death penalty, knowing the evil in the heart of man.

God was also personally involved in those areas. He wants as many souls as possible to find their way to him and killing them closes the window of opportunity.

As far as I'm concerned, some folks just need to be killed - I'm glad I'm not the one making the decision though - I understand the story of Jonah...he also knew the evil heart of Man and tried to keep from being a part of saving some that God wanted to have him minister to.

Sometimes being a Christian Conservative will set up conflicts....
