Navajo Nation files $160 M claim with EPA over mine spill

The Navajo Nation has submitted a claim of more than $160 million in damages to the federal government over last year's mine waste spill that fouled rivers in three western states.

A cleanup team led by the U.S. Environmental Protection Agency triggered the August 2015 spill while working at the Gold King Mine near Silverton, Colorado.

In environmental law, there are a number of regulations that set out criminal penalties for violations. There is no formal “intent” requirement, simple negligence is enough for a conviction. This would be the perfect place to enforce those laws.

Certainly, had this mess been unintentionally made by private individuals, there companies and themselves would be facing criminal sanctions and the EPA would be advising Lynch and her DOJ about how to do it.

$160 M seems very low to me. $160 B would be more like the real damages.

The spill covered not only the Tribe's area but all the way to Lake Powell which drains into the Grand Canyon all the way to Los Angeles.

My uncle had to stop irrigating from the San Juan River that summer. Melons were basically fist sized at harvest.

Gold King Mine DUMP?

I rode the train up Animas Canyon just last Friday and the sludge covering the bottom of the river is thick and fluffy. Can’t be a trout left in it.

The mine was leaking and the springs continued to fill it but it was at least somewhat filtered or solids settled water.

Complicated mess but EPA screwed up and has covered up unsuccessfully. The rest of us would simply go to jail in the deepest darkest pit with no hope for escape or release. EPA people go scott free.

The EPA and the contracting company were warned by a former area geologist about the grave risk their measuring techniques held re the release of extremely polluted mine waters into the nearby river.

But did they listen? NOOOO!

This time I’m on the side of the Indians. It is about time that somebody took some scalps of the EPA idiotship.

Prison time ...

A few weeks after the disaster I had a chance to visit with an official from another tribe. When she told me she would be meeting with Navajo leaders later in the year, I asked her to suggest they demand extradition of senior epa criminals to face tribal justice. Keeping my fingers crossed.
