I am so split on this... Pushing him would make the Sessions confirmation hearings a cake walk, Cruz likely would be stupid enough to resign his senate seat as the liberals will demand, and then they’ll proceed to Bork him on out.

I’m sure McCain will be right in front of the cameras stating how disappointing it was to find out all this stuff about a former fellow senator and it was good that he resigned so the senate didn’t have to take action against him.

Honestly, I don’t think we have time to play games, there’s too many opportunities for SCOTUS to write even more laws, and we need a solid jurist on the panel as soon as possible.

I was more saying that senate Dems would demand Cruz resign his senate seat before the confirmation hearings could begin (as they would probably not want him voting for himself like others have done...) and then would see to it that he washed out through the hearings and subsequent vote.

He could, I believe, still keep his senate seat and sit on SCOTUS, just would, as a matter of course, have to excuse himself from anything that would be related to senate business. Since so many believe everything is senate business, I’m not sure he’d be able to rule on anything.
