Lands activists urge Trump to revoke Obama’s national monuments

Western lands activists are urging Donald Trump to test the limits of executive power by revoking millions of acres that President Obama set aside as national monuments, setting up a landmark legal battle over one of the nation’s most frequently used environmental protections.

Such a step would be historic. No president has undesignated a national monument created by his predecessor, and it’s unclear whether he has the authority to do so.

But Obama administration critics say now is the time to try to establish a precedent. They say Mr. Obama has wildly abused presidential power in using the 1906 Antiquities Act to cordon off huge swaths of land and sea — mostly along the West and East coasts — to prevent energy exploration. In total, he has earmarked at least 553 million acres of land and water as national monuments, far more than any other president.

I was thinking of the offshore national monuments to prevent drilling and fishing.

Imagining cruising around in a boat, nothing but waves in sight, looking at the GPS, and wondering, “Are we there yet?”

Until the DC crowd starts putting large tracts of northeastern land into national parks, such as Civil War battle grounds as an example, I won’t believe in the need for any more national parks.

My point, exactly.

You’d think that the absurdities of the past 8 years of Obama, and the past generation of Clintons, would sink in and make it so they would be ignored. For a minority of people, that is the case; for most of the sheep it is not. There’s so many insults to veracity and critical intelligence, but for many, they seem to cancel out, so subsequent outrages have no impact.

There’s A LOT of work to be done. Trump is just the beginning.

If we are going to recover our Free Constitutional Republic, we all must work to reinstate the Constitution as written and originally understood and intended as the Supreme Law of the Land against the feds.

That means dismantling the unconstitutional 80%+ of the federal government - an impossible task BUT FOR God, who is in this with us (we’re really in this with Him).

This would include states REPOSSESSING THEIR lands from the unconstitutional usurpation and land grab of the feds including ALL “NATIONAL PARKS” turned over to the states (if the people of the states decide they can make them State Parks). National Parks and Obama’s National Memorials are “feel good” tyranny, which sooner or later turns into malevolent oppression. The ONLY legal justification for the feds to own land in a state is found in Art I, Sec 8, Cl 17 of the Constitution (land purchased from the state for buildings necessary for national defense).

Of course most all of Obama’s “executive orders” are per se unconstitutional and should be immediately revoked as unconstitutional legislation by the executive branch regardless of the merits of the act.

If one President can nationalize land by executive action then it stands to reason another President can return that land back to the States. You did not need a judge to nationalize the land and you do not need a judge to return the land back.

IIRC, there is a lot of corruption with the national parks. In particular, favored companies are allowed to log them for free or for very little cost. This flies in the face of the idea that they are preserving nature. They are just using them as an additional revenue stream for their cronies and destroying the nature that they pretend to care about.

The Grand Canyon Monument is mostly in my County. This would be devastating for us and for people recreating. We have been fighting this for years.

They took away the uranium mining in my County (before we knew they gave it to Russia) saying it was polluting the Colorado River without one scintilla of evidence.

All of them since Reagan should be undone. All “Wilderness” areas open. Our forests need proper management which includes logging. Maybe someday we can stop seeing these stupid fires that destroy millions of acres of timber and wildlife, not to mention human beings, structures, and billions of dollars in firefighting.

What a waste. Every year.

As a practical matter, I very seriously doubt Trump will reverse these. Further, like presidents before him, he will create his own.

What can and hopefully will do is change usage rules to allow public access and meaningful use of these lands. And respect for the 2nd amendment when using these lands.

What do you mean by “return to the states”? These lands were NEVER state lands. These are cherished federal lands and should be treated as such. I know I get flamed for it but I am thrilled that 82% of Nevada, where I live, is public land, meaning no No Trespassing signs. Very nice. We need to get better rules on access and use, that would be helpful.

If such a “monument was created by an Act of Congress (enacted with the President's signature or by overriding a veto) then a President *obviously* wouldn't be able to unilaterally rescind it.But if it was done solely by Presidential “decree” then it could be rescinded by a President.
