President-elect Trump is set to meet with retired Marine Gen. Jim Mattis Saturday amid speculation that Trump could tap him to serve as secretary of defense.
According to a pool report from the Trump transition team, Mattis is among eight people slated to meet with Trump on Saturday, including 2012 GOP nominee Mitt Romney, who is being discussed as a potential nominee for secretary of state.
Bloomberg reported Friday that Mattis and retired Gen. Jack Keane are in the running for secretary of defense.

Keane could be Secretary or Defense. Mattis cannot.

CNN reports that Mattis would just need a waiver from Congress - something that he’d likely be able to get.
I never knew about this guy until I talked to my Marine son , and he said the General is like a hero, a cult figure in the Marine Corps.
I hope he gets a position after hearing what Marines think of him. He is old time, get the military back to a fighting unit, and men act as men, real men, not the pansy crap getting in the military today.

Keane already took himself out of consideration after his meeting with Trump which occurred on Thursday. I saw an interview, I think on BOR Friday where he said he will not be on the cabinet. No explanations, just that he won’t.

Keane withdrew himself from consideration for personal reasons.

And CNN is never wrong are they? Here's the law in question: 10 U.S. Code § 113 Where does it say it can be waived by Congress?
General Keane retired in 2003. General Mattis retired in 2013. By law the Secretary of Defense cannot be a former serving officer if that officer left active duty less than seven years ago.
The only limitations on Congress are of the constitutional variety without an amendment. Whatever that statue says can be overridden with a waiver passed through both houses and signed by the executive. Period.
And that is based on what?
Based on the fact that Congress writes our laws.
