A defense lawyer Friday urged a federal judge to hold a hearing that his client Ryan Payne can attend in the fight to withdraw his guilty plea in the Malheur National Wildlife occupation case.
Payne doesn't want to waive his right to go to the hearing even if it's put off until after his prosecution in Nevada in the 2014 Cliven Bundy ranch standoff.
Payne's lawyer Richard Federico, reiterated that his client's guilty plea to the Oregon federal conspiracy charge rested upon the resolution of both the Oregpon and Nevada cases.
Prosecutors hace argued that Payne's guilty plea in the refuge occupation was not contingent on a plea agreement in Nevada.
But Federico said that the "entire foundation" of the Oregon plea deal was based on resolution of both prosecutions and Payne couldn't reach an agreement in the Nevada case.
Payne filed a motion Oct. 12 to withdraw his guilty plea. It came about two weeks before a federal jury acquitted Ammon Bundy and six co-defendants of a conspiracy charge in the 41-day occupation over federal control of public lands.
Payne's lawyer also said that his client didn't have all the information about government informants when he entered his plea......

The new Attorney General will need to clean this situation up with charges dropped and the accused freed from prisons.
The imprisoned ranchers from Oregon whose case led to the occupation-protest, the Hammonds (Dwight and Steven), should also be freed.
BLM needs to be whacked HARD. This is one of the things the new admin should be looked at and graded on. I am sure Jeff Sessions will not let an opportunity pass.
There should be a law requiring the prosecution to disclose such information. We could call that disclosure process "discovery".
At minimum they deserve Bail.
Right now they are nothing but political prisoners of the Obama regime.
We need to get the FBI and OSP to un-murder LaVoy Finicum as well.
