To privately sell or transfer a gun you have to go to a gun shop and fill out an affidavit swearing your buyer has never used or possessed any Federally controlled substance even if it is legal in your State, including MJ, testosterone treatments, anti-depressants, etc.
You also have to ascertain whether the buyer has ever been ACCUSED, not convicted or even charged, but simply ACCUSED of committing a crime. This is all part of compliance with the Brady Bill Federal firearms purchase requirements, which are routinely selectively ignored. Which makes it subject to the whim of some bureaucrat whether or not you will be prosecuted for getting it wrong or having the buyer lie to you.
