Judge denies Ammon Bundy's motion for mistrial

U.S. District Judge Anna J. Brown Friday denied a motion for a mistrial in which Ammon Bundy's lawyer claimed the Harney County sheriff had offered prejudicial testimony this week that the judge failed to address.

Bundy's lawyer Marcus Mumford had asked Sheriff Dave Ward during his cross-examination Wednesday if he had conducted his own investigation into the 2014 armed standoff near Bunkerville, Nevada.......

Ward explained that what he learned about the Nevada standoff "scared the hell" out of him. The sheriff went on to note that he had discovered during a Google search that "some unstable people who had left that situation" killed two police officers while they were eating in a restaurant.

In court Wednesday, Mumford asked the judge to strike Ward's comments, arguing they were unresponsive. The judge denied his motion. Bundy's older brother, Ryan Bundy, then stood up and objected, also asking the court to strike Ward's statements. He initially cited a hearsay objection but quickly contended instead that the comments were prejudicial.

They were prejudicial because they were "about the folks supposedly killing people that were not associated with us," Ryan Bundy argued in court......

In court Wednesday Brown sustained Ryan Bundy's objection and told jurors to disregard Ward's references to events in Bunkerville that had to do with police officers being killed.

Judge Brown heard oral agruments on Mumford's motion Friday afternoon and then ruled from the bench. She said that her limiting instruction to jurors was sufficient........

Sheriff Ward and the refuge manager both testified as to associate Ammon Bundy with violence this week and Bundy's lawyers called them on it by calling for a mistrial.

The judge rejected their arguments.

Some kooks and racists have been trying to disrupt the protests of patriots and peace loving people in support of those accused in the Oregon Standoff.

This is not about race, this is about a federal government out of control, operating way beyond the intentions of the Founders and the Constitution.

There are certain inalienable rights like "Life" for instance, but the federal government decided LaVoy Finicum was not entitled to "Life" when they committed the only act of 'violence' during the Oregon Standoff protest.

Everyone involved in the murder of Finicum need to get punishment. The deserve the same mercy they gave Roy and ultimately the same fate.

This whole thing should never have gotten this far. As soon as Americans stood up and brought attention to government overreach, the government should of acknowledged their blunder, made it right and then back off.

Instead, they double down on stupid. I guess we can’t have the serfs revolting.

Amen to each of your points.

You left out the conviction rate in a Federal trial. Regardless of guilt or innocence, the conviction rate is extremely high. In 2010 the rate was 93%. The Fed leaves no stone unturned to make their case as you have already demonstrated.
