Time to think about the statute of limitations?

It was all we could do in the wake of Saturday’s news of the discovery of Jacob Wetterling.

Well, perhaps not all. Perhaps we can talk about why there’s a statute of limitations in Minnesota for kidnapping and raping children.

Under Minnesota law, indictments or complaints must be made within nine years after the alleged crime was committed or three years after it was reported to law inforcements, whichever is later.

Is it epidemic? If not, the SOL is a good idea. Imagine, at age 50, someone goes a little nuts and accuses you of committing the crime when you were 23. It is not provable after such a long time. Heck, the nine years is a lot.

Imagine dropping all speed limits to 15 because a single person is killed in an auto accident. There is a certain risk level that is considered by our culture to be acceptable to afford the citizens freedom of movement - and freedom to not be accused of something that happened decades ago.

I assume the 9 year thingee is there so that someone raped as a young child can bring charges when they are old enough to do so.

There is, however, no statute of limitations on murder. Since the child was killed, why bother with the lesser charges?

There is a very good reason there is a statute of limitations on other crimes. Memories fade (or are created), evidence disappears.

Tough cases make bad law. A case like this could be used to advocate changing a law that protects us all and does not need changing. However, in this case, there is always the murder charge, so this case is not even tough.

They are talking through their hats on this one.

You can’t even get Rape kits processed in that amount of time in Memphis, some are 2 decades old and just being processed after there was more victims.

I believe there should be a statute of limitation on all crime. How do you defend yourself against a crime committed long ago?

There should be exceptions when DNA is found and you have a confession. This creep was caught within a short enough window that HIS DNA was still in 8 year old Nikki’s body.

Nikki was beaten, RAPED, strangled with her own shoelaces, wrapped in a green blanket, which was then tied, by David Keen, he dumped her body into the river off the old Auction Street Boat Dock in Memphis, TN. She drowned to death. Nikki was alive as Keen RAPED her. DNA proved he did and he eventually confessed to the crime. 2 juries, up held the Death Sentence. All State and Federals Appeals are done. Yet he still sits on Tennessee Death Row because Tennessee’s RINO governor won’t sign the Death Warrant for this Child Rapist/Killer.

It’s 2016 Nikki’s mother is still waiting for JUSTICE!

Time to think about a death penalty in Minnesota. While this scum will likely spend the rest of his miserable life in prison, he will still be getting his jollies recounting his exploits to others like him and costing the tax payers money to maintain his miserable carcass. I would be in favor of hanging baby rapers and making other child molesters watch the process.

This what I'm trying to understand; this guy Hienrich led them to the remains - making him the murderer or some form of an accessory.

Can he not be prosecuted?
