3 Walmart employees charged with manslaughter in death of shoplifter

Three Walmart workers in Florida have been charged with manslaughter in the February death of a shoplifter, police said Friday.

They are accused of suffocating Kenneth Wisham, 64, after he tried to steal $380 worth of DVDs in a shopping cart from the Walmart on North Road 98 in Lakeland Feb. 7, Fox 13 Tampa reported.

The station reported that the employees chased Wisham, who fell. They then held him on the ground.

As he was being restrained, Wisham stopped breathing.

There's lots of lessons to be learned from this. Here's two.

One, don't shoplift. And two, if you're going to restrain someone, you had better know exactly what you're doing.

A police affidavit quotes a witness as saying she saw Nunez knock Wisham to the ground and then pummel him with her fists.

Who was the woman pounding him (Wisham) with her fists?

If they use the Clinton defense, no intent to cause harm, then they will get off as they should.

Reading the whole report it sounds like there was a bit more going on here. Normally, you don’t break 15 ribs falling to the ground and being restrained. That is more than half his ribs, unless he stole a rack of ribs, in which case there were 15. Even knocking someone to the ground should not result in 15 broken ribs. Maybe he has osteoporosis? I wish they had been clearer on the mechanical asphyxia. They probably sat on him after they broke his ribs.

Just as well...the fella had been up to no good his whole life. He resisted his lawful apprehension.

Absolutely. They might not be convicted of anything, but their city would be paying out lots of money to settle a lawsuit.

Another article says one of the employees performed CPR. That can break ribs.

Why on earth would you think that? Just exactly who is going to prosecute a cop? LOL, wake up. Cops do whatever they want, and you take it. Or you die.

Shoplifting, misdemeanor petty theft and felony grand theft, are epidemic at the Walmart down the street. Also vehicle break-ins & thefts, assaults, drugs. Awful...and I live in a “safe” town. This is the store at which a skinhead shot & killed the manager, causing Walmart to phase out the sale of handguns. Magnet for society’s dregs.

I am fairly certain that Walmart specifically prohibits employees from chasing shoplifters out of the store, which appears to be the case.

These employees really screwed the pooch.

Most commercial liability insurance policies specifically prohibit this. This is why if you try to chase a shoplifter, at most establishments you'll probably get reprimanded and possibly fired.
