If Comey believes the the DOJ would not prosecute simply because of their perception of the validity of a law, then he is working well outside of his jurisdiction and presupposition that action should or should not be taken merely on how another organization would act. Not his job.

Since When did an Agency of the Executive Branch have a say on What is Constitutional or Not, My version of the US Constitution says the JUDICIARY decides these issues according to RULES SET FORTH BY CONGRESS. Nowhere does the EXECUTIVE BRANCH have ANY such Mandate.

The false statement law was strengthened some time ago from a knowing standard to a should have known standard. Seems DOJ has had no problem pushing that standard since then. It is akin to gross negligence.

The main reason that the gross negligence provision is so rare is because the training and standards for gaining access to Top Secret classified information pretty much ensures by default that anyone caught mishandling it is doing so with willful and knowing intent.
