Drugs are not mentioned in the Constitution but “life” is mentioned in the Declaration and the FDA is supposed to make sure that the foods and drugs we ingest don’t kill us.

The Declaration doesn’t determine what the federal government has the authority to do. If they don’t have Constitutional authorization to do something, then they aren’t “supposed” to be doing it, period.

The Declaration of Independence wasn’t a grant of government power. That rests solely to the Constitution.
