Third rebuke of administrations transparency this year
The White House showed bad faith in how it handled an open-records request for global warming data, a federal court ruled Monday, issuing yet another stinging rebuke to the administration for showing a lack of transparency.
For President Obama, who vowed to run the most transparent government in U.S. history, Judge Amit P. Mehtas ruling granting legal discovery in an open-records case the third time this year a judge has ordered discovery is an embarrassing black eye.
In this most recent case, the Competitive Enterprise Institute was trying to force the White House Office of Science and Technology Policy to release documents backing up Director John C. Holdrens finding that global warming was making winters colder a claim disputed by climate scientists. Mr. Holdrens staffers first claimed they couldnt find many documents, then tried to hide their release, saying they were all internal or were similar to what was already public.
But each of those claims turned out not to be true.
At some point, the governments inconsistent representations about the scope and completeness of its searches must give way to the truth-seeking function of the adversarial process, including the tools available through discovery. This case has crossed that threshold, the judge wrote.
Discovery is considered exceedingly rare in Freedom of Information Act cases, because the government is given the benefit of the doubt in claiming it tried to search for and release documents. But in three cases so far this year, judges have said called the Obama administrations efforts into question, finding severe oversights that suggest bad faith.

The Obamunists must be bitterly disappointed that their attempt to create a soviet style cult of personality failed.
From the start it was clear that they wanted to use their slavish army of followers to terrorize any and all opposition into paralysis and silence.
They see bad faith as a legitimate tool for advancing the struggle.
They no more believe in the concept of "good faith" when dealing with us than Winston Churchill believed in "good faith" when dealing with Hitler.
If some of these judges would start throwing these lying bureaucrats in jail for contempt of court then firing them much of this would come to a screeching halt.

How much do all these court cases cost Obama and his thugs? Nothing. It’s the taxpayers that pick up the bill.
So what they showed “bad faith.” So what a Federal judge rebuked them. And so what some Administration members have been found in Contempt of Congress. These are not bad consequences for the Administration. They are flouted badges of honor. Until Agency representatives and attorneys start being locked up and personally fined or lose their licenses to practices law, this is just one long rope a dope.

If warmists have be cooking the books in order to steal taxpayer’s money, they should be arrested, tried and put in prison.

A judicial remonstration does not matter. What matters is that the judges start issuing contempt of court citations as well as arrest warrants. Let’s see how many of these birds are willing to spend a few months in jail.
