The only sex-related protection that the states have amended the Constitution to expressly protect is voting rights as evidenced by the 19th Amendment. So regardless of vote-winning, unconstitutinal federal discrimination laws concerning gender, the feds actually have no constitutional authority to legislatively strengthen sex-related protections outside the scope of voting rights.
But by getting the corrupt federal government involved in PC transgender bathroom issues, LGBT activist are unthinkingly helping the federal government to unconstitutionally expand its powers, pro-LGBT activist justices predictably wrongly legislating LGBT protections from the bench.
It’s an impotent reaction to Oberfell. That’s all it is.

A starting point for discussion. If someone is transgendered, it is no fault of their own but I don’t know why they can’t go with their plumbing when using public restrooms.
THe threat is men who are sexual voyageurs and predators, esp. child pedophiles, who will pose a “clear and present danger” to young, unaccompanied children, esp. girls.
This is the approach that No. Carolina should take - ban companies that support mixed sex restroom usage on the ground that “they are aiding and abetting child predators and pedophiles”.
Put the onus on them to show that their support for the mixed bathroom policies DOES NOT CREATE A THREAT TO YOUNG CHILDREN AND WOMEN.
Name the businesses in public and categorize them as dangerous to the public safety. THEN YOU CAN BAN THEM FROM ANY PRESENCE IN YOUR STATE.
It would send one helluva message to the leftists and Restroom creeps. Officials of those companies could be banned from the state since they represent the policies of their leaders which comes under the “aiding and abetting” clause of the “clear and present danger” law, and could be arrested if caught in the state.
It might not pass a constitutional muster but it would certainly tie of businesses in court for months or years.
It is absolutely necessary to paint these businesses as “Friends of Pedophiles” in whatever legal language you could legally use.
THis is simply turning the Left’s tactics of smearing gun manufacturers as evil, greedy businessmen who aid the mentally ill and criminals in obtaining guns.
If sports organizations such as the NCAA get into the act, ban them from being involved with any state-funded university. Would love to see them banned from the Un. of No. Carolina (don’t know if Duke is state funded or not).
The Southern Poverty Law Center (SPLC) could be labeled a
“threat” group to children if they get involved. The same for the ACLU. The ACLU has no federal or state sanctioned standing that I know of. They are a private organization so they could also be “labeled” and “listed” as a threat, thought they might escape under the “legal assistance” rights of the Constitution.
Would be fun labeling them anyway, esp. of they helped keep child pedophiles out of prison.

If anyone questions him, he can merely say, “You’ve never seen a woman wearing jeans and a t-shirt before?”

In my home state, Washington (which should be renamed Confusion as long as the libtards are in control) it is against the law for businesses and government facilities to deny men from entering women’s restrooms and changing rooms, and vice versa. Maybe a woman should go with a man she knows both with cellphones and she enters the Ladies room while the man stays outside. If, she sees an obvious male in there leering at women and little girls she should call her male friend or husband outside, and when the perp leaves the restroom her male companion could beat up the perp. There’s a risk he could go to jail for assault, but if he does he would be a self sacrificing hero and would discourage the perp from doing it again. It would be worth it to go to jail to punish a perp leering at undressing women and girls.
