I’ve dealt with photography a great deal in my field, royalties, restrictions, model buyouts, etc. and I suspect there’s a contract violation somewhere, for this image of her to have been used in a detrimental manner. Unless, that is, the rights were bought out by GQ before this occurred.

Cruz screwed himself on this (no pun intended)...
Instead of absolutely denying he ever had an affair with any of those women, or any other woman, he talked like a weasely attorney and didn't put it to bed (no pun intended). He left a thousand ways to claim later he was truthful. He also waited too long and let the silence be filled with speculation and a thousand sub-stories.
This story exists today because Cruz didn't get on top of it immediately (no pun intended).
If this all bothers you, I suggest you gripe at Cruz.
