North Carolina passes bill blocking LGBT protections

The North Carolina legislature on Wednesday passed a sweeping bill overturning gay and transgender protections at the local level and requiring students to use public restrooms that correspond to their biological sex.

Legislators said immediate action was necessary to protect children and women from sexual predators who might pose as transgender to gain access to women’s restrooms.

But gay rights groups called the measure blatantly discriminatory and condemned it as the most extreme bill of its kind in the nation.

“Legislators have gone out of their way to stigmatize and marginalize transgender North Carolinians by pushing ugly and fundamentally untrue stereotypes that are based on fear and ignorance and not supported by the experiences of more than 200 cities with these protections,” Sarah Preston, acting executive director of the American Civil Liberties Union of North Carolina, said in a statement.

Russert asked Trump about gay marriage. Trump didn't want to comment on it, but said he has no problem with gays in the military.

He explained, "I've lived in New York City and Manhattan all my life, okay? So my views are a little bit different than if I lived in Iowa."

When Russert asked Trump about abortion, he said he's "pro-choice in every respect" and again cited his New York background, which he said has a "different attitude" from most of the country

"It's not the first time Trump has taken a pro-LGBT stance. As far back as 2000, Trump was advocating the idea of amending the 1964 Civil Rights Act to prohibit discrimination based on sexual orientation - something the currently-pending Equality Act would basically do if lawmakers on Capitol Hill ever decided to pass it.

"Amending the Civil Rights Act would grant the same protection to gay people that we give to other Americans - it’s only fair," Trump told The Advocate in February, 2000.

In the same interview, Trump said he favored "a very strong domestic-partnership law" that guaranteed same-sex couples equal legal rights as married, heterosexual couples.

Trump also said he believed Don't Ask, Don't Tell - the military's then-ban on openly gay service members - had "clearly failed."

Trump's spokesperson, Hope Hicks, did not immediately respond to msnbc's request for comment on where the presidential candidate stood on the Equality Act. But his longstanding support for ending discrimination against gay people has been well documented. ..."

Lost cause ETL and your tagline explains why. Trump has been on every side of every issue probably several times and he’s switched parties as often. I like his in your face style but don’t trust him at all.

When I hear Trump supporters calling Cruz “establishment” then I have my answer as to their sanity and you’re confusing these folks with facts about their New York outsider savior.

When the results came in a few weeks ago in NC, the GOP in that state realized they no longer had control over their grassroots including religiously conservative people because Trump finished first and Cruz second taking over 3/4 of the primary vote.

I strongly suspect that led to this sudden special legislative session and sudden legislation in opposition to the LGBT movement.

It may be appropriate to say He changed his mind or claims to but you do not believe him, though the number of years involved makes that claim sound spurious.

The jist of your post is to make the claim that HE STILL ADVOCATES THAT POSITION. He clearly does not.

How are gays discriminated against under this bill? The law requires male and female homosexuals and heterosexuals to use the restrooms that correspond to their biological sex. There is no discrimination against gays specifically in the legislation.

Since gays are not explicitly discriminated by this this new law, the only class of people affected are individuals who are biologically of one sex and for whatever reason desire to use the public restroom of the other sex. These people could be transsexuals or they could be voyeurs or they could be individuals trying to commit sex crimes.

While data is difficult to come by, current estimates of the gay population range from 2% to 3.8% of the population. Current estimates of the transgender population range from 0.2% to 0.3%.

The purpose of the law is to protect females from rape and sexual attack by male rapists. Sociological studies of the population indicate that rapists comprise 6% of the male population and 20% of the female population has been raped by that 6%.

Since transgenders cannot be easily be identified by externally visible physical attributes, they must self identify. The self identification aspect of transgender makes it easy for male rapists to pretend to be transgender in order to gain access to female restrooms, where having gained admission they can easily prey on females using the restroom.

The North Carolina legislature in passing the bathroom use law is in effect saying protecting the non transgender female population (99% of females) from rape by 6% of the male population, is greater than the the benefit derived by the 0.3% of the male population that self identifies as transgender. The state is condoning discrimination against 0.3% of the total population in an effort to protect the overwhelming majority of the female population from sexual crimes.

Progressives argue on its fact the law authorizes sexual discrimination forbidden by the Constitution. However, the Constitution does not address sexual discrimination in its text. To reach the conclusion the North Carolina law is unconstitutional requires unelected judges to read into the Constitution rights that are not in the text. Obviously, under progressive leadership the court has over the years taken the power to make such declarations because the other two branches have allowed it to do so. Hence we have a situation where courts can rule the NC law unconstitutional.

Unfortunately for progressives, their judges over time have also ruled rights explicitly delineated in the Constitution are not absolute. Affirmative action based on race, which is outright discrimination, has been upheld as in the interests of society. Courts have ruled free speech can be limited on college campuses, courtrooms, and other public places. Courts have also ruled religious expression can be limited. Finally, with respect to sexual discrimination courts allow scholarships and awards to be awarded to members of a specific sex, allow clubs and other organizations to be single gender, and allow affirmative action (i.e. overt discrimination) based on gender in the public and private spheres. Given these legal precedents a case can easily be made for the NC law. The compelling societal good is protecting the female populations from male rapists by restricting restrooms to single gender.

Over 100 years of progressive interpretation of the Constitution has resulted in a situation where almost every right or privilege, or every legal prohibition, has no basis in common law or written law. It is subject to the interpretation and dictates of the unelected judiciary who follows not the letter of the law but personal beliefs and the changing tide of public opinion.

Hence, when this case comes to court the judges will be examining their own beliefs and biases, as well as the opinions of those they admire or are beholden to, instead of the legal issues. In a sane world the case would be a slam dunk in favor of the state of North Carolina:

1) The law does not discriminate against any class of people defined in the constitution as receiving protection.
2) The state has a compelling interest to protect females from male predators.
3) The power to regulate public restrooms is not given to the federal government or the federal courts by the Constitution. Therefore, per the 10th Amendment, the power to regulate (or not) the use of public and private restrooms belongs to the state and the people.

Unfortunately this case will be litigated in courts dominated by jurists schooled not in the rule of law but in the theory of the “living Constitution”. Those same jurists in their private lives will associated primarily with progressives who support the transgender agenda. The jurists therefore will interpret the law based on their personal biases and the opinions of their friends and associates. The outcome is predictable.

Don't forget that most of the real slime in this campaign has been done by Cruz supporters and he claims deniability (ala Obama) because he didn't personally do it and he first heard of it on Twitter and TV....Not to mention his two biggest supporters are now Romney and Bush (and the GOPe).

Can have the same problem leading "Cruz or Lose"ers to facts and making them understand them.... '

There’s plenty of politics in this, with the Dems crying foul and the Republicans trying to restore credibility with religious voters who deserted them in droves to vote for the unsanctioned presidential candidates in North Carolina and other southern states like Georgia, where new religious freedom legislation was suddenly passed last week.

Its watered down, but still a surprise with the governor in GA mulling his signature over big business opposition.

Trump expects forward motion on gay rights as president

Donald Trump said forward progress on LGBT right would happen on his administration.

In contrast to other recent remarks, Donald Trump said on Thursday progress on gay rights would continue under his administration and cast himself as a uniter of people regardless of their views on the issue.

Trump made the remarks in New Hampshire just days before the state’s primary in an interview with New England Cable News’s Sue O’Connell, who’s also publisher of the Boston-based LGBT newspaper Bay Windows.

O’Connell, a lesbian, asked Trump if the country can look for more “forward motion” on gay and lesbian rights if he’s elected to the White House.

“Well, you can,” Trump answered.”

And look, again, we’re going to bring people together, and that's your thing and other people have their thing. We have to bring all people together and if we don’t we’re not going to have a country anymore.”

It’s hard to say what kind of forward progress would happen on LGBT rights under a Trump administration.

In a 2000 interview with The Advocate, Trump said he supports amending federal civil rights law to include sexual orientation. Although Trump has said in this election cycle companies shouldn’t fire people for being gay, but hasn’t said whether he still supports amending federal law to achieve that goal or whether he would also support protections for transgender people.

Meanwhile, Trump has signaled qualified support for the First Amendment Defense Act, federal religious freedom legislation seen to enable to anti-LGBT discrimination. An opponent of same-sex marriage, Trump said on Sunday he would consider appointing justices to the Supreme Court who would reverse the ruling in favor of marriage equality.

Gregory Angelo, president of Log Cabin Republicans, said the remarks reveal a glimmer of hope Trump would be a friend to LGBT people in the White House.

“As I’ve long said, putting all else aside — and with Donald Trump, that can, at times, be a herculean task — there is a legitimate case to be made that Donald Trump would be an ally to the LGBT community as President of the United States,” Angelo said. “Trump confirmed that today.”
