Thomas DiMassimos attorney does not think his client will be charged in state court, but that the federal misdemeanor charge will go forward.
I dont think hes going to be charged in both jurisdictions, said Jon Paul Rion, who added that he didnt think DiMassimo would be in Dayton Municipal Court on Tuesday. Its clear that Thomas is simply a college student who, in his mind, was simply engaging in a form of political speech and making a statement, in his own mind.
He is not a member of any organization. Those statements (of DiMassimos possible ties to ISIS) are completely without basis.
The federal crime DiMassimo is accused of carries a one-year maximum sentence after a conviction. If a weapon had been used or serious physical injuries had been suffered, there could have been a 10-year maximum.

Why was he let out ON BAIL the SAME day as the act? Why was he given the opportunity to not only use social media but appear on network news? (I’m calling out CNN).
He risked a castrophe. He violated Federal statutes by his actions.
One year? A start. But by his OWN public admission (tweets, and in his interview in air) he wanted to TAKE the microphone and podium from Mr. Trump. Isn’t THAT action (the physical overtaking of the microphone and podium) turning those items, by force, into weapons?

I’ve read that the best you can do with the Feds is to negotiate the best settlement. They have an incredibly high conviction rate.

I believe that getting him on the national networks cemented the case against him. Speaking on film without having an attorney next to you is just STUPID !

This can NOT BE a misdemeanor. And the second layer of charges (Ohio) needs to be held in place also. NO concurrent sentences. ALL time MUST be served. This cannot be permitted.
The Ohio jurist, who allowed bail (which by the way was set at what amount?!?) needs questioned as to his/her leniency. Why was he let go immediately?
This was dismissed too quickly and swept under the rug (because it’s Trump??? Because if that’s the case anarachy reigns.)
Jail time in a Federal facility. No early parole. Full sentence.
Secret Service protection puts this Act of Violence in a different light. It is a physical threat against someone deemed to have the protection of a future president.
Lawyer talk? Those ISIS ties “completely without basis” is not the same as “totally untrue”.
Maybe charging one Caucasian with a 10-year crime will prevent persons of color whose “lives matter” from committing more felony’s.

One of the screen clips showed blood on the hand of the Secret Service agent as DiMassimo was hauled off.
