Trump University plaintiff seeks to withdraw from lawsuit

SAN DIEGO (AP) — Tarla Makaeff has had enough of Donald Trump after spending six years fighting him in court.

The Southern California yoga instructor wants to withdraw from a federal class-action lawsuit that says Trump University fleeced students with an empty promise to teach them real estate. Her lawyers said the Republican presidential front-runner and his team have put her "through the wringer" and made the prospect of a trial unbearable. A judge will consider the request Friday, four days before Florida and Ohio hold their primaries.

Trump's attorneys say the lawsuit should be dismissed if Makaeff is allowed to withdraw, arguing that their trial strategy centers on her. They deposed her four times and identify her as "the critical witness" in a court filing.

Makaeff's attorneys say Trump's argument that their client is indispensable to the billionaire's defense "is illogical to the point of being nearly incomprehensible." They note the judge allowed two plaintiffs to withdraw last year; three others would remain.

The tussle in one of three lawsuits against Trump University comes as the case nears trial, possibly this summer. A trial date has not been set, but a final pretrial conference is scheduled for May 6 and Trump appears on a list of defense witnesses who may testify at trial.

The lawsuit has figured prominently in the presidential campaign, fueled by legal filings and Trump's statements. In depositions that took place in December and January and were released last week, Trump acknowledged that he never met instructors whom his marketing described as hand-picked, and that some unqualified candidates had "slipped through the cracks."

The Better Business Bureau said Tuesday that it rated Trump University a D- in 2010, which improved to A+ by January 2015 as the business appeared to wind down

When you buy something there is usually have a grace period in which to could request a refund. Once you’re past that date, you can’t request a refund. Buyers remorse years later is ridiculous

So, for clarity: this suit that dominated a debate and is a cornerstone of anti-Trump politicking will now consist of a ‘class’ of three plaintiffs. Three.

So this class-action suit started with 6 people, 2 have already dropped and this lady now wants to make it 3,,out of how many Trump U students?

Trump said he could have settled but he wants this to go to trial. Maybe this lady is seeing she is not going to get the payoff she was trying to extract.

Oh well.

IMO .She can dismiss only if the Judge lets her because there has been huge expenses that she will have to pay to Donald!! A counter claim exists for frivolous law suit. She and her co political operatives have played with the wrong Dog.

She's the one who started this.

And Trumps seminars had an A rating until the lawsuit. Then they solicited former "students" and they knocked it down to a D cuz all of a sudden they got 23 complaints??

Trump filed a suit against her saying she was malicious. The court found that she was NOT malicious in her suit and her lawyer did very well in the settlement. Well, she was. Now she wants to opt out...probably because she had made a video praising the seminars....before her suit.

The whole thing is a "sue the deep pockets" example.

Remember, evidence is irrelevant, it's the seriousness of the charge.

For the left, all that matters is that the charge was made...

Except when the charge is against one of theirs...ie Hillary, and ALL her scandals...then it's just a right wing conspiracy.

Trump’s team upping the pressure to lower bad press?

Trump is very used to using lawsuits as a way to handle those he cannot sell with his promises. I think the current count is 169.

I think the difference is, this gal was looking for a deep-pocket settlement, whereas Megyn is looking to become deep-pockets herself.
