The President (any President) is still the Commander in Chief. How do you get around that?

With this statement, this man utterly condemns the entire US military for obeying ANY of Obama’s orders. A command that is not lawful for a POTUS to give is NOT a lawful order - that’s what this guy is saying. That means that the buck stops at the Joint Chiefs. When THEY obeyed any order that an ineligible POTUS gave, it was THEY who disobeyed the law.

IOW, at this point the law REQUIRES them to disobey Obama’s commands. We have no lawful Commander in Chief, and the head of the DOD has the DUTY of defending this nation, against the wishes of Barack Obama.

He’s right, but it’s not that big of a deal.

The military, the CIA, and any part of the government, and anyone we hire or deal with, are now restricted from using any techniques not in the U.S. Army interrogation manual.

This is because the National Defense Authorization Act of 2016 that Congress passed last fall now makes that illegal. It doesn’t matter whether or not the CIA’s method of waterboarding is torture. It’s not in the manual, and now it’s illegal.

But I said it doesn’t matter. The next Congress can pass another law to make it possible. They’ll do it when they think it’s in their interest.

Democrats lied when they said they opposed waterboarding, and they can flip the other way. It just takes the right circumstances, and the right kinds of excuses.

Once that happens, someone in the CIA and military will do it. It’ll take a President who has their back.

War is the ultimate extreme and when you partake in it, you partake in extremism. In WW2 we killed entire families by the thousands, in entire cities in Dresden and Tokyo, burning them to death.

If Trump tells the terrs that he will destroy their cities,I am ok with it.

This guy is saying these would not be lawful orders because even the POTUS can’t disobey the Geneva Convention, etc. Which is what he’s saying Trump’s talk now comes down to.

Of course, there was no talk of any of that when Obama was involved.

Is it against the Geneva Convention for a nation to invite to a memorial an imam who curses the bodies of your military heroes?

Last I looked we are not signatory to the Geneva Conventions. Other treaties may apply perhaps.

I think what Hayden is saying is “The CIA/FBI are used to Obamas restrictions and will resist change for fear of being charged with crimes later on.”

I think what Trump is saying here is “there are a lot of options that push the boundaries but are legal”

The man is ridiculous.
ISIS is not a signatory to the Geneva Convention.
The Geneva Convention rules were created by basically civilized, white European nations, for when their disagreements turned into warfare. No they didn't always stick by those rules but for the most part those warring nations did did follow the rules of warfare they created for themselves, i.e. treating prisoners humanely, etc.

ISIS is not civilized and is not a legitimate government that is represents anybody. Their cruel, bizarre, vicious behavior towards anybody who isn't them precludes them from any of the protections provided by the Geneva Convention rules of warfare.
