State's Top Criminal Appeals Court Dismisses Felony Charges Against Former Gov. Perry

A lower court had already dismissed the coercion charge, ruling that the law it was based on was unconstitutionally vague. The Court of Criminal Appeals upheld that dismissal.

As to the abuse of power charge, the court ruled the Governor's veto power cannot be infringed on:

"The governor's power to exercise a veto may not be circumscribed by the Legislature, by the courts, or by district attorneys (who are members of the judicial branch). When the only act that is being prosecuted is a veto, then the prosecution itself violates separation of powers."

Were these charges more or less like those in an effort to destroy Tom Delay?

If so, I wish the courts would start bringing charges against the people who are playing them for political gain. That is an actionable criminal enterprise.

The court should be able to recognize it and take action.

Lawfare

Lawfare is a recently coined word not yet appearing in the Oxford English Dictionary, a portmanteau of the words law and warfare, said to describe a form of asymmetric warfare. Lawfare is asserted by some to be the illegitimate use of domestic or international law with the intention of damaging an opponent, winning a public relations victory, financially crippling an opponent, or tying up the opponent's time so that they cannot pursue other ventures such as running for public office, similar to a SLAPP (strategic lawsuit against public participation) lawsuit.

Works for me.

I will say though, that the person who has been wronged, should have the judge step in where there’s clear subterfuge going on.

It’s frivolous lawsuit, clearly trying to subvert the system, and abuse the court (that very judge) to attain their goals.

That should be a red flag for a judge. If you and I walked into that court and tried to pull a fraud on that judge, how many minutes would be it be before we were behind bars?

Perhaps judges are leery to pull that trigger, all cases having people trying to make a claim from their vantage point, but most of them are not trying to subvert a political process to deny citizens their election choices.

Delay had won his election and was serving his term in office. These folks used the judicial system to deny the citizens and Delay of their constitutional rights.

Where does he apply to get his reputation back?

The prosecutor who brought these charges should be given the Nifong treatment and never be allowed to work in law again.

The law is NOT supposed to be used as a political weapon
