Justice Scalia's unexamined death points to a problem

When my husband called and told me the news that Supreme Court Justice Antonin Scalia had died, the first question that came out of my mouth was, "Where?"

"Texas," he said.

"Oh no."

That reply did not surprise him.

I have been called to testify as a forensic pathology expert in many legal cases in Texas. I know about the laws that govern death investigation in that state.

It came as no surprise to me that Justice Scalia, found cold and pulseless in bed with a pillow "over his head," was declared dead of natural causes without an autopsy being performed. I was not shocked to hear that a county justice of the peace agreed to issue the death certificate without visiting the death scene or seeing the body for herself.

When President John F. Kennedy was shot and killed in Dallas on November 22, 1963, the local medical examiner, a trained and experienced forensic pathologist, wanted to perform an autopsy.

He was thwarted by the Secret Service, which followed the wishes of the President's widow and flew the body out of state for an autopsy at a naval facility. Even the Warren Commission report and thoroughgoing congressional hearings never put to rest the speculation that still surrounds John F. Kennedy's death -- and that death was indisputably a homicide, with an autopsy.

Scalia's unexamined death will add to the conspiracy theory industrial complex. It didn't need to be so, especially since Scalia's pre-existing medical conditions make it likely that his death was a natural one.

Why is it that in a nation with the best medical technology in the world, we are still allowing a law enforcement official and a judge on the end of a telephone line to declare someone dead

Why?

1. Most Texas Law Enforcement personnel and Judges are pretty good at their jobs.

2. Nothing about this is like JFK’s murder.

3. Have you ever been to the area around Marfa and Presidio? One look at the geography will make you wonder how anyone lives there. (except hunters come to such places)

4. I respect the families wishes in this instance.

An article well worth the time spent reading and I agree with Dr. Melinek even it is does come from CNN.
My father died 53 years ago this coming November at age 53. I have never been satisfied that he died as the result of a heart attack. But that is what the county coroner, a highly trained MORTICIAN listed as cause of death.
As is the case with Justice Scalia, we, the family deserved more.

In the event of a homicide an autopsy is required. In the event of a natural death an autopsy is not. There were no signs of foul play, confirmed by U.S. Marshals and local law enforcement. Justice Scalia was in poor health, confirmed by his physician. No reason to suspect the death was due to anything but natural causes. Under those circumstances then the wishes of the family should be granted. No autopsy.

A conversation of any length with Scalia-was-murdered theorists reveals that an autopsy and medical records would in no way deter them from conspiracy theories.

Amen. But you and I seem to be alone on this. I’ve spent time down there, and even further west. Everything is hours from each other. The “natives” do a lot of things differently than those of us in more populated areas.

And finally, knowing how the man died is somewhat moot. He is dead. And the means of his death is irrelevant to his replacement process.

We need to change our laws so that all jurisdictions have the same guidelines for staffing, funding, accreditation and certification of personnel trained in death investigation.

No we don't. Why is it that the solution to every problem has to be the concentration of more power in Washington?

I don’t believe that the current administration had anything to do with his death. If they had wanted to kill him so they could replace him, they wouldn’t have waited this long.

I do believe they are happy about it, and working to put in someone favorable to their cause.

What is really telling is that since the Clinton reign of terror how many Americans believe an elected official is capable of orchestrating murder. The left feels so righteous and smug that any means are justified in their minds. Lies, deceit, deception, distortion of facts, character assignation...why not murder?

I’ve been to Presidio many times on business. I know the country. I traveled the West and Midwest for 30+ years.

Urban dwellers can never understand. Those remote places still depend on each other as a community. They are more connected to nature and reality.

I grew up in the Big Nothing between Ft. Worth and Lubbock.

On the back door of the Wagner and 6666’s Ranches. I hunted quail, dove, hogs, turkey, deer from my youth. I love to hunt quail with a good bird dog. God bless Scalia and his legacy.

Any conspiracy theory about the death of Scalia should first consider that men comparable to him in age, weight, overall health, etc., are in the high risk category for death.

Scalia was 79 years old, had a history of heart trouble, including high blood pressure, and was recently deemed too weak to undergo surgery for a torn rotator cuff.

True, and the JFK assassination is an excellent example.
Texas law required that the autopsy be conducted in Texas, where the murder had occurred. The assumption being that the trial would be held in Texas, with a Texas jury, and the body itself is state’s evidence.
The Secret Service said no, this is the POTUS, not just any homicide victim, which gives this case federal jurisdiction.
The Parkland doctors did not want to surrender the body.
The Secret Service, fearing a rigged autopsy and coverup by Texas authorities, prevailed (threatened to arrest, IIRC) and the body was flown to DC and autopsied at Bethesda.
Bobby Kennedy was Attorney General, too.

Due to the tracheotomy, and various other emergency procedures, as well as hastily scribbled rough draft of notes by Parkland doctors which had to be taken into account during the federally-conducted autopsy, some conspiracy theorists have posited ever since that either or both of the doctors at Parkland and those at Bethesda were somehow part of a coverup conspiracy.

As for Scalia? He could not possibly have been murdered with a pillow. Suffocation leaves burst capillaries in the eyes and face that would have been noticeable.
If he was murdered by a CIA poison-dart which mimics a heart attack, this cannot be detected in an autopsy. So the question becomes moot. While murder has not been ruled out by autopsy, it might not have been “ruled in” either, had one been conducted.

Yet conspiracy theorists will forever cite lack of an autopsy as “ evidence” that Scalia’s COD “must have been” murder.

The conspirators are the ones who believe anything from this conspiratorial goverment. Our entire government is run by conspiracy. Benghazi was due to a video, there is not a shred of evidence the IRS broke laws, we are fighting ISIS in Syria, our financial system is sound, the US governnment did not aid and abet the 911 terrorists, the Fukushima reactors did not melt down and explode, we are not supporting actual NAZIs in the Ukraine, open borders do not create a national security risk, attackers yelling Allah Akbar while killing Americans are not terrorists and not part of Islam, removing the debt ceiling limitation is not a sign that government debt is out of control, and on and on. At some point a thinking man has to wake up, preferably without a pillow on their head.

That’s NOT what they said. They wanted to get Johnson out of there and he wouldn’t leave without Jackie, who wouldn’t leave without JFK’s body. Hence, they took the body. The more sinister theories suggest that either due to their incompetence or even their complicity they wanted the body out of there so they could have more control over an autopsy. The idiots in the SS in that day had no idea what federal jurisdiction even meant. They had a badge and a gun but in almost no other way were they law enforcement officers like they are now. They did believe that when it came to the POTUS, they and only they had ANY say. Of course, they still believe that today.
