The killer worked for the county and was issued this phone. He did not return it. The idea they could have retrieved it from te cloud is horseshit. Farook stopped backing it up to his cloud account 6 weeks earlier. It’s in all the papers. That is why this solution, like all the manure about not being able to comply, is bogus. And they ere in a hurry because the phone was found on the backseat of the car the killers were driving until they got aerated. The faster you recover info on a terrorist cell, the better the intel. If you appreciate the value of the 4th amendment to prevent people who have done wrong from hiding information, then you should be in favor of getting intel on the people who KILLED 14 PEOPLE.

The full text of both the court order (it’s short, and fairly plain (tech) English), and Apple’s response, are below, but to us one interesting aspect of the court order is this paragraph:

Apple’s reasonable technical assistance shall accomplish the following three important functions: (1) it will bypass or disable the auto-erase function whether or not it has been enabled; (2) it will enable the FBI to submit passcodes to the SUBJECT DEVICE for testing electronically via the physical device port, Bluetooth, Wi-Fi, or other protocol available on the SUBJECT DEVICE and (3) it will ensure that when the FBI submits passcodes to the SUBJECT DEVICE, software running on the device will not purposefully introduce any additional delay between passcode attempts beyond what is incurred by Apple hardware.

Now, it’s important to understand that in legal documents such as court orders, the word “shall” has a very specific meaning. It means “you will do it, no ifs, ands or buts”.

What Apple is being ordered to do in the above paragraph is to basically disable the time-out function that happens when you put the wrong passcode into an iPhone, and the ultimate destruction of the data on the phone after too many attempts, so that the FBI can attempt to discover the passcode and unlock the iPhone.

He also supported Bill Clinton signing the Assault Weapon Ban and he thinks Blomberg was a great Mayor. He likes the Obamacare individual Mandate and thinks Planned Parenthood does great things

Hmm I think I am seeing a pattern with the Mouth.

Exactly. I have no sympathy for terrorist scum but a government eager to dispense with due process is a danger to all of us going forward.

The government is entitled to every last scrap of evidence it is ABLE to collect. It doesn’t get to have it delivered on a platter. It then must convince a judge and/or a jury that the evidence is legitimate and proves guilt.

You know, it's not like The White Mosque has been involved in MANY directives protecting the homeys of the Caliph-In-Chief.

What's that one that's been rattling around here for a couple of weeks - where Mudslime information was suppressed at the behest of the White House?

I'll have to go fishing...

So. The government geeks screwed up. Big time. Then, to get out of their mess they sue Apple hoping they will fix it while trying to make Apple look like they’re helping terrorists while they, the government, is “only trying to protect the public”....

Perfect.

This is getting really confusing. I am told Apple could not retrieve this info, now they are telling me they could have if the passcode had not changed. I am keeping an open mind on this, but this just keeps getting stranger.

People keep introducing a bunch of histrionics into this subject. The herd of uninformed people have been stampeded by Apple's assertion that the FBI wants to crack all their phones, and that this terrorist phone is the means by which they intend to do it.

Now this stuff has flooded the internet.

How is it that the phone could be in the hands of a county guy?

It's a cellphone. You can send data to it from pretty much anywhere.

I’m not a fan of Apple but they are right. If Apple “creates software” to hack this phone, the FBI or “some other agency” will subpoena it afterwards despite the FBI’s assurances (note that they cannot make agreements enforceable on any other agencies). When the FBI or other agency obtains it by subpoena, since it now exists, it will be on the internet within hours.

The Feds do not have the moral, ethical, or professional standards to protect anything. If some employee doesn’t sell it, some slack-jawed self proclaimed IT expert will allow it to be hacked and stolen.
