(HOT!!!) California Student Information Released to Nonprofit

Millions of public school students will soon have their personal information and school records handed over to a nonprofit community organization.

The Concerned Parents Association fought for the data in federal district court and won over the objections of the California Department of Education. SDUSD Alerts Parents to Student Info Release.

The nonprofit said it needs the information to see if California schools are violating the Individuals with Disabilities Education Act and other related laws. The database it will have access to includes all information on children, kindergarten through high school, who are attending or have attended a California school at any time since Jan. 1, 2008.

The database contain students' names, social security numbers, home addresses, course information, behavior and discipline information, progress reports, mental health and medical information, along with suspensions, expulsions and more.

What, you can’t legally share that information, so how does s non profit get the information to take the next generations ID just like that?

This is a good example of why the iPhone blowup is complete horsecrap. The government already has your mother’s shoe size, and if they want, they can share that with other governments. WHAT ELSE DO THEY WANT.

Those people who go “off the grid” really have something. I wonder what ever happened to them...

Parents can protect their children’s vital information using a few simple steps and telling the school district to pound sand when more detail is sought.

Case-in-point: school district money is assessed with a specific USPS zip code hence only a zip code+4 is required, a full street address is not.

Other “lack of info” registrations can be recoursed through parents’ rights to protect their children. Items such as full name requirements, medical/inoculation info and any identifying information regarding the child’s safety moving to/from school.

I foresee a class-action.

Each and every child on that list should be kept track of and the first time that they have their ID’s stolen, sue the crap out of that nonprofit and it’s officers, possibly with a class action. The former students might not win, but they can make the lives of the people in that organization hell for years. They may even destroy it. The government (un-sueable, unfortunately) gave it to them, but they didn’t have to accept it.

NOTICE OF DISCLOSURE OF STUDENT RECORDS

This is a message from the United States District Court in the case identified above. This notice may apply to you if you are: the parent or guardian of a child (including an infant) with disabilities; the parent or guardian of a student who is attending or attended a California school at any time since January 1, 2008; or a person over the age of eighteen who is attending or attended a California school at any time since January 1, 2008.

Examples of information that is stored on CDE’s databases and network drives includes name, social security number, home address, demographics, course information, statewide assessment results, teacher demographics, program information, behavior and discipline information, progress reports, special education assessment plans, special education assessments/evaluations, Individualized Education Programs (IEPs), records pertaining to health, mental health and medical information, student statewide identifiers (SSID), attendance statistics, information on suspensions and expulsions, and results on state tests.

On May 5, 2014, the Court issued a Protective Order that prevents any party from disclosing confidential information acquired in the course of the lawsuit, including student records, to anyone other than the parties, their attorneys and consultants, and the Court. None of the information may be used outside the context of this lawsuit, and the parties are required to either return or destroy the confidential records at the conclusion of the lawsuit. No student’s identifying records will be disclosed to the public.

CONSENT AND OPPORTUNITY TO OBJECT If you do not object to the disclosure of the information described above, you do not have to do anything. If you object to the disclosure of your or your child’s protected personal information and records, you must notify the Court by April 1, 2016, in one of two ways. First, you may print out and complete the “Objection to Disclosure of Student Information and Records Case No. 2:11-CV-03471” form at the CDE’s website www.cde.ca.gov/morganhillcase, and mail your objection to the Court at the address below. Second, you may write a confidential letter to the Judge, including the name of the student on whose behalf you are writing, your name and relationship to the student, the student’s date of birth, county, school district, and school, and, if you wish, the basis of your objection.

Federal District Court allows personal information of MINORS to be released to a private advocacy organization— and thus, the public. Outrageous. Think of how many pedophiles work at this outfit. One more erosion, like homo Boy Scout leaders.

I guess children don’t have “the right to be alone”, although they seem to have picked up a whole number of rights over the last 30 years.

PII protections these days are a complete joke.

We need to come up with another mechanism to identify people other than PII. Perhaps biometrics.
