Congressman Readies Ted Cruz Eligibility Lawsuit With Eye on Mom[Rep. Grayson]

A Florida Democrat and some Obama "birthers" agree about Cruz.

Billionaire businessman Donald Trump suggested this week his nearest rival for the Republican presidential nomination may be ineligible for office and won a daylong echo across the political press, despite Texas Sen. Ted Cruz's attempt to brush off the commentary.

In raising the issue, Trump said Republicans should be concerned about Democrats hog-tying Cruz with a yearslong legal challenge -- and indeed an effort to do just that already is afoot.

Rep. Alan Grayson of Florida, an attorney and Democratic Senate candidate, tells U.S. News he will file a lawsuit challenging Cruz's eligibility should he overtake Trump and win the nomination -- a scenario that's at least plausible with the senator besting Trump in some Iowa polls.

Cruz was born in Calgary, Canada, in 1970 to an American mother and a Cuban father who later gained U.S. citizenship. There's no court precedent on whether foreign-born Americans meet the Constitution's "natural-born citizen" requirement, but there's more to scrutiny of Cruz's eligibility.

"If he's not qualified to be president according to our Constitution, then he certainly should not serve," Grayson says, poring over his notes for the possible lawsuit. "There's quite a lot of stuff here."

n addition to the question of whether Cruz's birth in Canada disqualifies him from being considered a natural-born citizen, for which there are clashing historical claims, Grayson notes there's disagreement about whether both parents of U.S. citizens born overseas must be citizens.

And then there's Cruz's mother, Eleanor Darragh Wilson.

Grayson says Wilson may have forfeited her U.S. citizenship by taking a Canadian oath of citizenship, and that he's seen no evidence she actually was born in the U.S.

If Cruz’ mother took an oath to become a Canadian resident/citizen Cruz is dead as a candidate. This could become a real test for conservatives; i.e. The Constitution or loyalty to Cruz and D*mn the Constitution.

I don’t want to hear anyone say “Well if it wasn’t for Trump nobody would have done this.” They were itching to do this already. In fact if I had to bet I would say that Trump and Cruz worked together to bring this up now and get it out of the way.

Grayson is an absolute kook of the highest degree. Nasty, vile person, too.

That said...

1. Until the Canadian Citizenship Act, 1976 - Canada did not ALLOW DUAL CITIZENSHIP.
2. Ted Cruz parents were CANADIAN CITIZENS only when Ted Cruz was born in CANADA in 1970 thus Ted Cruz cant get US citizenship via his parent.

First, there is no evidence to support such an assertion. People keep throwing that innuendo out there, but no one has provided anything to support it.

Second, even if she did, it would depend upon when she did so. If it was before Cruz was born, then no, he would not be an American citizen at birth. If it was after he was born, then it wouldn't change anything with regard to his eligibility.

This rumor has been floating around for a couple of years and no one has ever provided evidence. It is just more innuendo.

Ok it is rumor. However, the real issue being litigation against Cruz. Such a suit would tie up Cruz for years.

Until somebody produces some documentation to that effect, can we just assume that Cruz has never beaten his wife?

Nobody making the charge that Cruz’s mom applied for Canadian citizenship has one shred of anything to back up the claim.

Interesting about Canada's Citizenship Act, thanks. But - If Cruz's mother did not formally surrender her American citizenship, she never lost it. And if Canada didn't allow dual Citizenship until 1976, then she could ONLY have been an American when Ted was born in 1976 - there literally wasn't a Canadian alternative in legal existence yet.

It's been said around here that she lost her American citizenship when her husband switched to become a Canadian. All I can say is that this must be an Islamic theory of citizenship based on a wife being a husband's property, because it sure doesn't exist in United States law. In the US, wives are actually consisted to be human beings who choose their own citizenship status. To contend otherwise is barbarism and deserves contempt.

Several of these lawsuits have been filed against Cruz, Rubio and Jindal and all have been dismissed.

Please provide links to the documents showing that Ted's mother has ever been naturalized as a Canadian citizen. Since you speak with such authority, I must assume that you have documentary evidence to back up your assertion...
