It says... "not descend to persons whose fathers have never been resident in the United States."

How does that apply to Cruz? His father was a legal resident of the US for quite a while before he married Ted's mother, and before they moved to Canada. Note that it does not say "fathers who have never been citizens of the United States."

Wasn’t the case in 1970:

Declaration of Renunciation (was taken at the same time as oath from January 1, 1947 to April 2, 1973)

I hereby renounce all allegiance and fidelity to any foreign sovereign or state of whom or which I may at this time be a subject or citizen.

I did NOT say that the naturalization act of 1790 qualified Sen Cruz. I DID say that is set the precedent of not requiring being born on US soil. I further stated that the reason that Sen Cruz was a NBC was based on CURRENT law, title 8 section 1401 subsection G.

Further, Sen Cruz’s father DID reside in the US.

Perhaps you missed the part of shall be as natural born?

According Harvard, natural born citizen = citizen at birth. So if Cruz’s mother was a U.S. citizen when he was born, then according to that rule he is a natural born citizen. We haven’t yet seen proof that she was a U.S. citizen at the time of his birth.

Spoiling it for the democrats and the media. They were going to wait until Cruz got nominated before suddenly “discovering” that he was born in Canada. The media would then go 24/7 over it, raising doubts in the minds of just enough Americans to get them to vote for hillary.

I note that Cruz doesn’t say “My mother was a US citizen when I was born.” Instead he says she was born in the US, and she is now a US citizen. End of debate.

It gives the impression that he’s a slick attorney finding a weasel way around the question.


Hence why I have to side with Don Trump and say this is precarious. At the end of the day, it probably won’t matter as Cruz is way behind in the polls. But it may be an issue again in the VP selection.

From the Timeline referenced in the OP:

Rafael Cruz has publicly stated that he remained a citizen of Canada until he renounced his Canadian citizenship when he applied for and became a Naturalized citizen in 1974. As a result, his wife and son were also Canadian citizens, his son being born a citizen of Canada in 1970.

Can you link to the law at the time that required them to renounce US Citizenship? I’m not familiar with 1950s Canadian immigration law.

Are you simple? That’s no more evidence that Ted Cruz’ mother was not a US citizen than it’s evidence that I am not a US citizen or YOU are not a US citizen. By the way, I AM a US citizen.

Also you’d still need to show on the US side that her citizenship was renounced. Just because Canada may say they require that doesn’t mean that she actually did it. That’s a Canadian issue not US to deal with.

Oh good - then you should have no problem finding the document showing his mother made such a declaration if she became a Canadian citizen. If you can't provide such documentation, then any claim that she did so is wild speculation by another round of birthers.
