Obama to bolster gun background checks

Washington (dpa) - US President Barack Obama is seeking to expand background checks on gun buyers as part of efforts to be announced Tuesday that attempt to keep more criminals from getting guns.

The Bureau of Alcohol, Tobacco, Firearms and Explosive will clarify its rules to require anyone engaged in the business of selling firearms regardless of the location to have a license and conduct background checks, US officials told reporters late Monday.

"The goal is keeping bad actors away from firearms," Attorney General Loretta Lynch said.

The move that Obama will announce aims to target sellers who have avoided registering as gun dealers, even though they are regularly doing so for profit, including online and at gun shows.

It does not target private sales by hobbyists or collectors and stops short of setting a number of guns that must be involved to require a seller to register as a gun dealer.

"Just because you shop with a mouse not with your feet doesn't mean you should not undergo a background check," advisor Valerie Jarrett said.

The administration also seeks to eliminate a loophole that allowed gun buyers to avoid background checks if they were acting through a trust or other legal entity.

The executive action, a means of circumventing Congress, also seeks to improve the federal background check system with more information on criminal and mental health records and by hiring more examiners to process background checks.

Obama is also proposing 200 additional gun enforcement agents, 500 million dollars for mental health services and additional research on safe gun technology.

Obama said earlier Monday that he had asked his team to "work together to see what more we can do to prevent the scourge of gun violence in this country."

Obama's efforts to enact tougher gun control laws following the mass shooting of students at a Connecticut elementary school in 2012 were blocked by Congress and his calls for similar measures following subsequent shootings have failed to gain traction.

He has instead been forced to rely on a series of executive actions, which do not carry the force of law and can easily be reversed by future presidents.

Obama met Monday with Attorney General Loretta Lynch, FBI Director James Comey, Thomas Brandon, deputy director of the Bureau of Alcohol, Tobacco and Firearms, and other advisors. He also met with Democratic lawmakers about the efforts.

0bama and the left always seem to side with the bad actors. They really want to prevent law-abiding citizens from using guns against bad actors, also using guns. Leftist redistribution in action.

stops short of setting a number of guns

That's so they can pick an easy target, someone poor shmuck who sold two or three, but one went to a guy who ends up killing his wife with it. Then they pick off the rest of the sellers one at a time for the next 20-30 years until they get all sales registered and all guns tracked.

Remember this about Executive Orders:

1. “Executive orders” are directives for use within federal agencies, only to federal employees. They “order” those employees to enforce existing law. The president has no legislative power over the people.

2. They are directives valid only within the Executive Branch.

3. They direct only agencies within the Executive Branch

4. They cannot direct an agency to perform an illegal or unlawful act

5. They cannot be unconstitutional (e.g., a direct infringement of any of the Bill of Rights).

6. They are NOT laws, but DIRECTIVES

Just where can I buy a modern firearm on the internet without an FFL and a background check? I don’t think it’s possible.

Any non-business, persn to person sale within your state can be legally conducted without a background check and you can also legally ship the firearm direct from seller to buyer intrastate without going through an FFL.

There are any number of gun auction type sites on the net where you can hook up with sellers from all over or just your own state. Try Armslist for starters.

If Obama had the real legal authority to do what he is trying to bluff his way to do he would have quoted it. That it took so long and had so many of his staff investigating his authority to do so indicates how sketchy his legal reasoning is. Even if he is challenged in court the Dems will use it to shame voters into supporting their candidates in November...what, you don’t want to save lives?
