He is a Democrat. The Law does not apply to them.
The question should be: Why would the Obama administration deny him access to the list?
That is a clear violation of the Second Amendment. Deprivation of constitutional rights without due process is a felony:

I’m okay with the death penalty (through due process) for gun grabbers.
I am hoping the NRA is going to be on top of this in less than a day.
Finding someone on the no-fly list, who is not a real threat , and who will be lead plaintiff should be a piece of cake.
Of course the government can kill their standing to sue by removing them from the list, but that may be a good thing. Attempting to buy a gun could be the cheapest way to get off the no-fly list.
