“She’s too big to jail,” said national security attorney Edward MacMahon Jr., who represented former CIA employee Jeffrey Sterling in 2011 in a leak case that led to an espionage prosecution and 3½-year prison term. He cited a pattern of light punishments for top government officials who have mishandled classified information while lower level whistleblowers such as Sterling have faced harsh prosecutions for revealing sensitive information to expose waste, fraud or abuse in government.

A little misleading in the title. It is not the FBI saying she is too big to jail. It is an attorney saying this.

A little misleading in the title. It is not the FBI saying she is too big to jail. It is an attorney saying this.

In today's PC climate, an FBI official could not afford to expose citizens to the unvarnished truth.

Oh I think the FBI would present the facts and a recommendation for action to the DoJ. It is up to Loretta Lynch implementing Obama’s wishes to take action on that. This is the point where we’d see just how invested Obama is in Hillary and whether they have struck a deal or not.

That’s total BS.. an email doesn’t have to be marked classified for someone to know if it’s classified. I could write classified information on a bar napkin. She knew much of the info was classified and at what level of classification.

The headline says it all “She’s to Big for Jail”.

$#@%!$#@*! government is totally incompetent. Prosecute the bitch to the full extent of the law... and Obama with her.

She instructed aids to send “TS/SI/TK NOFORN” material to her private server.

Those were satellite images that are marked at that level when they are generated.

If they weren’t marked when they got to her, that’s actually worse.
Because is would mean that the markings were actively obscured.

Anybody in the business KNOWS their classification simply by glancing at them. There’s no need to study the image in detail.

Every step in the process of moving and manipulating those images, to get to her e-mail, is a FELONY for both the acting and instructing parties.
AND the receiving party for not reporting it!

If the FBI is looking at the as gross negligence in a prosecution under the Espionage Act I don’t think the fact that something’s not marked or that the person may not know that it was classified would be relevant at all. Classification isn’t even an issue in how national security information was handled or whether she informed the president of her arrangement.

An ex-CIA person commented on this last week. IIRC, emails from heads of state, their representatives, foreign ministers are, by default, classified. As such, they’re rarely marked with “Top Secret”, “Classified”, etc. It’s understood and was covered in PIAPS’ training. So, she uses Clinton-speak to try to cover her crime.

Like Bubba saying he didn’t have sex with that woman, Miss Lewinsky, “not a single time”. That was true. It wasn’t a single time. It was many times. They are so good at the baffle-gab.
