Yeah, she probably should have paid closer attention in her carry class.
I’d say she’s pretty lucky to be facing minor charges, and also lucky that she didn’t kill or injure anyone.

My Father once shot the tires of the car of a young man who had stolen his heart medication. I assume it was narcotics.
The kid made it around a mile before the rims wore out. The deputy came by, arrested the kid and told Daddy that maybe next time he should just phone them. He did not ever threaten Daddy otherwise.

I am only surprised they didn’t charge her sooner. No one likes property crime, but it isn’t something to shoot over when the suspects are fleeing.

Bad shoot. The threat was no longer present (it was fleeing), and thus the shoot was unjustified. And even if he hadn’t been fleeing shooting a shoplifter is not shooting a direct physical threat, and will get the shooter in trouble big time.
Now, if the bad guy was running away with the woman’s child, then the shoot would have been justified.

Can’t shoot at someone if they are fleeing for a non-felony theft crime. Even it it was a felony theft, you have to give them a warning first. See Garner v. Tennessee, 471 U.S. 1 (1985)
