Priced a real M-4 lately?
If not for 922(o), a real select-fire M4 would be around $1000.
There is no substantive difference between that and the closest semi-auto model (which I own).
_Heller_ has a footnote to the effect that should the illegality of the canonical M16 be challenged, NFA & 922(o) would fall.
Some town will come up with only single shot .22s are allowed if SCOTUS doesn’t toss this ban. You know the gungrabbers are waiting for this opening.
922(o) is mentioned in Breyer's dissent. In the majority opinion, Scalia says long-standing prohibitions are presumed constitutional.
... nothing in our opinion should be taken to cast doubt on longstanding prohibitions on the possession of firearms by felons and the mentally ill, or laws forbidding the carrying of firearms in sensitive places such as schools and government buildings, or laws imposing conditions and qualifications on the commercial sale of arms.26 ...---

The M-16 is mentioned too, in a way that suggests that it is constitutional to criminalize the possession.
It may be objected that if weapons that are most useful in military service--M-16 rifles and the like--may be banned, then the Second Amendment right is completely detached from the prefatory clause. But as we have said, the conception of the militia at the time of the Second Amendment's ratification was the body of all citizens capable of military service, who would bring the sorts of lawful weapons that they possessed at home to militia duty. It may well be true today that a militia, to be as effective as militias in the 18th century, would require sophisticated arms that are highly unusual in society at large. Indeed, it may be true that no amount of small arms could be useful against modern-day bombers and tanks. But the fact that modern developments have limited the degree of fit between the prefatory clause and the protected right cannot change our interpretation of the right.
Without argument or providing any evidence on the point, Scalia's point of view is that the M-16 is not "in common use at the time [Heller sued]."
You may have a different footnote in mind, and I'd like to discuss it if so. Many people saw Heller as opening a door. I saw it then, and see it now, as preserving status quo, at best. All SCOTUS has to do to find a new restriction to be constitutional, is to deny cert for long enough, that whatever has been banned is no longer considered "in common use," and then take a case. SCOTUS has been abominable on RKBA cases, even when the Circuit Courts read SCOTUS opinions for the opposite of what they say - as long as the lower courts are jailing people for possession of arms.

Apparently you are unaware of the relevant laws.
Federal Code 922(o) banned the possession of full-auto weapons, made after 1986, by citizens.
“Colt Factory M16A1 Class 3 Full Auto ... Buy Now for $25,900.00” Well, that’s because there is an extremely limited (and shrinking) pool of legal machineguns. Demand is very high, supply is very low, prices rise accordingly. They’re not weapons anymore, they’re investments (like a fine painting you don’t hang on the wall, you put it in an environment-controlled safe).
“No real M4s on gunbroker currently.” Well, that’s because there are no real M4s made before 1986. They’re illegal to own.
If, somehow, you ARE allowed to buy a new M4 (there _are_ ways), they cost around $1000.
The military, police, and well-connected bodyguards sure aren’t paying $25,000 for their assault rifles.
I am very aware of the laws. Like I said find me a real(that isn’t worn out) Colt M4 for $1,000 and I will be there with bells on. The military cost on them was about $700 in 1994 dollars.

My point. The lefties misuse the term ‘assault weapon’ but WE know it`s only an assault weapon if it has a selector which will allow fire in semi-automatic as well as FULLY automatic mode. So that was my point, a little sarcasm there, get it?
